Abstract
Rahasia bank adalah segala sesuatu yang berhubungan dengan keterangan mengenai nasabah penyimpan dan simpanannya yang wajib untuk dirahasiakan keterangannya. Bank mempunyai kewajiban merahasiakan keterangan mengenai nasabah penyimpannya. Kewajiban Bank untuk merahasiakan data mengenai Nasabah penyimpan dan simpanannya menunjukkan bahwa Undang-Undang Perbankan memberikan perlindungan kepada Nasabah berdasarkan prinsip kerahasiaan, yang berlaku pula bagi pihak terafiliasi dengan Bank sebagaimana yang diatur di dalam Pasal 40 ayat (2) Undang-Undang Nomor 10 Tahun 1998 Tentang Perbankan (UU Perbankan). Mengenai rahasia Bank ini, Pasal 40 ayat (1) UU Perbankan telah mengatur bahwa Bank wajib merahasiakan keterangan Nasabah penyimpan dan simpanannya, kecuali dalam hal-hal tertentu. Namun di dalam prakteknya masih banyak ditemukan penyalahgunaan terkait dengan data dan keterangan-keterangan nasabah yang dilakukan oleh pegawai Bank. Penelitian ini mengkaji tanggung jawab Bank dalam hal terdapat pegawainya yang membocorkan data nasabah, dalam kaitannya dengan Perbuatan Melawan Hukum dalam hukum perdata. Hal ini dikaji dengan melakukan studi kasus terhadap Putusan Nomor 145/Pdt.G/2019/PN.Amb Tanggal 20 Februari 2020. Penelitian ini merupakan penelitian yuridis normatif dengap pendekatan kasus. Hasil penelitian ini menemukan bahwa tanggung jawab Bank dalam hal ini dapat berupa ganti rugi dan pernyataan telah melakukan Perbuatan Melawan Hukum, yang pada gilirannya menurunkan kepercayaan nasabah kepada Bank./Bank secrecy is everything related to information regarding depositors in the Bank and their deposits which must be kept confidential. Banks have an obligation to keep information about the depositing customers confidential. The obligation of the Bank to keep data about its depositing customers and their deposits confidential shows that the Banking Law provides protection to customers based on the principle of confidentiality, which also applies to parties affiliated with the Bank as regulated in Article 40 paragraph (2) of Law Number 10 of 1998 on Banking (Banking Law). Regarding this bank secrecy, Article 40 paragraph (1) of the Banking Law stipulates that Banks are required to keep the information of their depositing customers and their deposits confidential, except in certain cases. However, in practice there are still many abuses related to customer data and information carried out by Bank employees. This study examines the responsibility of the Bank in the event that its employees leak customer data, in relation to tort as it is known in civil law. This was reviewed by conducting a case study on Decision Number 145/Pdt.G/2019/PN.Amb dated February 20, 2020. This research is a normative juridical research with a case approach. The results of this study found that the responsibility of the Bank in this case can be in the form of compensation and a statement of having committed a tort, which in turn reduces the customer's trust in the Bank.
