Abstract
Layanan Konsumen Ditinjau Dari Peraturan Otoritas Jasa Keuangan No. 01/Pojk.07/2013 Dikaitkan Dengan Market Conduct dan Asas Itikad Baik. Pesatnya laju perkembangan perekonomian global telah memberikan dampak yang signifikan terhadap pembaharuan segala sektor, tidak terkecuali sektor keuangan. pembaharuan sektor keuangan ditandai dengan kemunculan teknologi finansial. Hadirnya Fintech dinilai telah memainkan peran vital dalam eskalasi perekonomian suatu negara. Selain itu, sektor keuangan mendorong pertumbuhan ekonomi riil melalui konsolidasi antara modal dan kebaharuan teknologi. Salah satu jenis dari teknologi finansial adalah peer to peer lending (p2pl) yang secara umum diartikan sebagai suatu bentuk layanan pinjam-meminjam uang yang didalamnya terdapat pihak peminjam, pihak pemberi pinjaman dan pihak penyedia layanan dengan memanfaatkan media teknologi secara daring. Kehadiran p2pl selain memberikan kemudahan dalam bidang jasa keuangan juga memberikan tugas baru bagi pemerintah, secara khusus berkaitan dengan regulasi, POJK No. 01/POJK.07/2013 adalah salah satu regulasi yang mengatur tentang layanan tersebut dimana OJK sebagai lembaga berwenang di sektor keuangan memiliki tugas untuk melaksanakan pengawasan dan perlindungan konsumen. Berangkat dari paparan latar belakang tersebut, penelitian ini hendak mengkaji bagaimanakah upaya pengawasan p2pl berlandaskan prinsip market conduct serta bagaimanakah upaya perlindungan terhadap pengguna layanan p2pl dikaitkan dengan prinsip itikad baik ditinjau dari POJK 01/POJK.07/2013. Jenis penelitian yang digunakan adalah penelitian normatif dan bersifat perskriptif. Jenis data yang digunakan adalah jenis data sekunder yang terdiri atas bahan hukum primer dan bahan hukum sekunder. Teknik pengumpulan data yang digunakan oleh penulis adalah studi dokumen dan teknik analisis data menggunakan teknik analisis secara kualitatif. Pengawasan market conduct oleh OJK belum dapat dilaksanakan secara optimal. Kondisi tersebut dikarenakan POJK No.01//POJK.07/2013 belum mengatur secara spesifik perihal defenisi, bentuk serta mekanisme pengawasan market conduct oleh OJK. Berkaitan dengan perlindungan terhadap pengguna layanan p2pl berlandaskan prinsip itikad baik terpresentasi dalam ketentuan Pasal 3 yang mensyaratkan adanya itikad baik dari konsumen/pengguna berupa penyediaan segala dokumen tentangnya secara akurat, jujur, jelas, dan tidak menyesatkan. Ketentuan ini menjadi awal terlaksananya serangkaian mekanisme perlindungan oleh OJK sebagaiman terdapat dalam rumusan beberapa Pasal dalam POJK a quo./The rapid pace of global economic development has had a significant impact on the renewal of all sectors, including the financial sector. The renewal of the financial sector is marked by the emergence of financial technology. The presence of Fintech is considered to have played a vital role in the escalation of a country's economy. In addition, the financial sector encourages real economic growth through the consolidation of capital and technological innovations. One type of financial technology is peer to peer lending (p2pl) which is generally defined as a form of money-lending service in which there are borrowers, lenders and service providers by utilizing online technology media. The presence of P2PL in addition to providing convenience in the field of financial services also provides new tasks for the government, specifically related to regulations, POJK No. 01/POJK.07/2013 is one of the regulations governing these services where OJK as the authorized institution in the financial sector has the task of carrying out consumer supervision and protection. Departing from this background explanation, this study aims to examine how P2PL supervision efforts are based on market conduct principles and how the protection of P2PL service users is related to the principle of good faith in terms of POJK 01/POJK.07/2013. The type of research used is normative research and is descriptive. The type of data used is secondary data which consists of primary legal materials and secondary legal materials. Data collection techniques used by the authors are document studies and data analysis techniques using qualitative analysis techniques. Supervision of market conduct by OJK has not been carried out optimally. This condition is because POJK No.01//POJK.07/2013 has not specifically regulated the definition, form and mechanism of market conduct supervision by OJK. With regard to the protection of users of p2pl services based on the principle of good faith, it is represented in the provisions of Article 3 which requires the existence of good faith from consumers/users in the form of providing all documents regarding them accurately, honestly, clearly, and not misleadingly. This provision is the beginning of the implementation of a series of protection mechanisms by the OJK as contained in the formulation of several articles in the regulation.
