Abstract

Nama : BENNY HUTAHAYAN NIM : 1902190013 Judul : KAJIAN ASAS CABOTAGE DALAM UNDANG UNDANG NOMOR 11 TAHUN 2020 TENTANG CIPTA KERJA DAN PERUBAHAN UNDANG-UNDANG NOMOR 17 TAHUN 2008 TENTANG PELAYARAN Undang-Undang Cipta Kerja yang disahkan pada 5 Oktober 2020 mengubah sebagian ketentuan-ketentuan di dalam Undang-Undang Pelayaran yang akan memengaruhi industri pelayaran di Indonesia. Aspek utama yang sangat penting adalah penerapan asas cabotage di dalam pasal-pasal Undang-Undang Cipta Kerja, untuk kemajuan industri pelayaran dan perlindungan hukum pelaku usaha domestik di Indonesia. Tujuan penulisan ini adalah untuk menganalisis dan mendeskripsikan perubahan yang terjadi dalam Undang-Undang Cipta Kerja terhadap Undang-Undang Pelayaran, khususnya penerapan asas cabotage. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan menganalisis bahan hukum primer berupa peraturan yang terkait dan juga data sekunder. Hasil dari penelitian ini adalah terdapat 68 ketentuan dalam Undang-Undang Pelayaran yang diubah di Undang-Undang Cipta Kerja. Dengan penjabaran, sebanyak 64 pasal yang diubah, 1 pasal tambahan, dan 3 pasal dihapus, serta 6 penjelasan pasal. Perubahan mencakup topik angkutan di perairan, kepelabuhanan, keselamatan dan keamanan, serta ketentuan sanksi administrasi. Terdapat 3 hal utama yang berubah, yaitu (1) mengembalikan kewenangan kepada pemerintah pusat yang selama ini banyak diberikan kepada pemerintah daerah, (2) memberikan peluang kepada asing untuk dapat melakukan investasi di bidang pelayaran khususnya migas, (3) adanya relaksasi asas-asas cabotage. Di sisi lain, dapat diketahui bahwa Undang-Undang Cipta Kerja memberikan kepastian hukum bagi pelaku usaha serta memberikan perlindungan hukum terhadap para pihak dalam industri pelayaran. Akan tetapi, Undang-Undang Cipta Kerja memberikan kesempatan kepada pelaku usaha asing pelayaran migas untuk beroperasi di Indonesia sehingga kurang memberikan rasa keadilan terhadap pengusaha domestik. Selanjutnya, diperlukan penelitian yang mendalam terkait prinsip cabotage yang paling ideal dan adil untuk semua pelaku usaha, baik domestik maupun asing. Kata kunci: undang-undang, asas cabotage, cipta kerja, pelayaran./ Name : BENNY HUTAHAYAN ID Number : 1902190013 Title : STUDY OF CABOTAGE PRINCIPLES IN LAW NUMBER 11 YEAR 2020 CONCERNING WORK CREATION AND AMENDMENT TO LAW NUMBER 17 YEAR 2008 REGARDING SHIPPING The Job Creation Act, which was passed on October 5, 2020, changes some of the provisions in the Shipping Law that will affect the shipping industry in Indonesia. The main aspect that is very important is the application of the cabotage principle in the articles of the Job Creation Act, for the advancement of the shipping industry and the legal protection of domestic business actors in Indonesia. The purpose of this paper is to analyze and describe the changes that occurred in the Employment Creation Act against the Shipping Law, especially the application of the cabotage principle. The research method used is normative legal research by analyzing primary legal materials in the form of related regulations and secondary data. The result of this research is that there are 68 provisions in the Shipping Law which are amended in the Job Creation Act. With the elaboration, as many as 64 articles were changed, 1 additional article, and 3 articles deleted, as well as 6 explanations of articles. Changes cover topics of transportation in waters, ports, safety and security, as well as provisions for administrative sanctions. There are 3 main things that have changed, namely (1) returning authority to the central government which has been given to local governments, (2) providing opportunities for foreigners to be able to invest in shipping, especially oil and gas, (3) relaxation of principles cabotage. On the other hand, it can be seen that the Job Creation Law provides legal certainty for business actors and provides legal protection for parties in the shipping industry. However, the Job Creation Law provides an opportunity for foreign oil and gas shipping business actors to operate in Indonesia so that it does not provide a sense of justice to domestic entrepreneurs. Furthermore, in-depth research is needed regarding the most ideal and fair cabotage principle for all business actors, both domestic and foreign.
