Ringkasan Isi : Meningkatnya peminatan terhadap film-film yang berasal dari Indonesia maupun mancanegara membuat pelanggaran hak cipta karya film berkembang dan berevolusi mengikuti kemajuan teknologi. Hal ini menyebabkan banyaknya situs website penyedia aktivitas streaming/download film yang diunggah tanpa seizin dari pencipta dan pemegang hak cipta. Metode penelitian yang digunakan metode penelitian hukum normatif, metode ini dilakukan dengan meneliti bahan pustaka yang ada. Jenis data yang digunakan dalam penelitian ini adalah data sekunder dengan mengkaji konsep perlindungan terkait hak cipta karya film di media internet dan pertanggungjawaban hukum pelaku penyedia jasa layanan streaming/download. Pada Undang-Undang Nomor 28 Tahun 2014 yang menganut sistem Hukum Civil Law; pengadopsian doktrin perlindungan hak cipta; serta yang mengatur ketentuan terkait konten hak cipta pada teknologi informasi dan komunikasi, membuktikan Undang-Undang ini lebih efektiv dalam menjamin perlindungan Hak Cipta Sinematografi. Praktiknya penegakan perlindungan belum cukup maksimal, sehingga dibutuhkan peran aktif pencipta atau pemegang hak cipta serta aparatur penegak hukum untuk saling mengawasi dan melindungi. Selama aktivitas streming/download dan pengunggahan film dalam situs website di internet dilakukan tanpa seizin pencipta dan pemegang hak cipta tetaplah suatu pelanggaran. Pihak-pihak yang dirugikan dapat meminta pertanggungjawaban hukum, secara pidana maupun keperdataan untuk mendapatkan ganti rugi. Content Summary: The increasing interest in films originating from Indonesia and abroad has caused copyright infringement of film works to develop and evolve following technological advances. This causes many websites that provide streaming / download movie activities that are uploaded without the permission of the creators and copyright holders. The research method used is normative legal research method, this method is carried out by examining existing library materials. The type of data used in this research is secondary data by examining the concept of protection related to copyright of film works on the internet and the legal accountability of actors in streaming / download service providers. In Law Number 28 of 2014 which adopts the Civil Law system; adoption of the doctrine of copyright protection; as well as regulating provisions related to copyright content in information and communication technology, proving that this Law is more effective in guaranteeing the protection of Cinematographic Copyright. In practice, the enforcement of protection is not maximal, so it takes an active role for creators or copyright holders and law enforcement officials to monitor and protect each other. During the activity of streming / downloading and uploading films on a website on the internet is done without the permission of the creator and copyright holder, it is still a violation. The aggrieved parties can ask for legal responsibility, both criminal and civil, to get compensation. Accountability is imposed with the aim of providing a deterrent effect on the perpetrator.
