Ringkasan isi : Tujuan dilakukannya penelitian terhadap Keppres No. 12 Tahun 2020 tentang Penetapan Bencana Nonalam Penyebaran Corona Virus Diesase ( Covid – 19 ) sebagai bencana Nasional yang sangat di harapkan berdampak positip terhadap meningkatnya Kesehatan masyarakat secara nasional . Sebelum Keppres No. 12 Tahun 2020, pemerintah telah mengeluarkan Keppres No. 9 Tahun 2020 dan diberlakukan pada tanggal 13 April 2020 tentu Pemerintah Daerah akan memperhatikan kebijakan pemerintah pusat dan sebagai Ketua Gugus Tugas Percepatan Penanganan COVID-19 akan merespon serta mengajukan wilayah atau daerahnya kepada Pemerintah dalam hal ini Menteri Kesehatan untuk bisa menyetujui program pencegahan virus covid-19 , sebagaimana Gubernur DKI Jakarta mengajukan program PSBB untuk disetujui penerapannya di wilayah DKI Jakarta dan disetujui oleh Menteri Kesehatan dengan SK No. HK.01.07 / Menkes/239/2020 yang merupakan peraturan pelaksanaan keputusan PSBB untuk khususnya di daerah DKI Jakarta begitu juga denga daerah dan wilayah lainnya di Indonesia akan membuat kebijakan yang sama dalam rangka pencegahan penyebaran virus corna -19.. Terbitnya keppres No.12 Tahun 2020 dan dengan adanya peraturan daerah yang diberlakukan serta penerapan adanya jarak yang diberlakukan dalam segala aktivitas (Physical Distancing) yang membatasi dan melarang untuk segala aktivitas dan operasional bisnis usaha , melihat fakta hukumnya bahwa wabah virus covid -19 ini sebegitu dashsyatnya di luar kendali dan tidak terduga sehingga telah memakan korban harta, jiwa, perekonomian dan bisnis mengakibatkan masyarakat maupun khusunya pengusaha / pebisnis tidak mempunyai kemampuan untuk bertahan dalam menjalankan usahanya serta mempertahankan karyawannya ( PHK ) belum lagi bisnis yang dituangkan dalam suatu perikatan atau perjanjian, dengan adanya halangan covid-19 ini baik secara langsung atau tidak langsung mempengaruhi para pihak dalam memenuhi kewajibannya yang telah disepakati dalam suatu perjanjian / kontrak, segala cara sudah dilakukan untuk bisa mengambil langkah – langkah menghindari dampak mewabahnya virus covid-19 ini ternyata tidak bisa berhasil sehingga menimbulkan wanprestasi bagi debitur karena tidak mempunyai kemampuan memenuhi kewajibannya. Dengan terbitnya Keppres No. 12 Tahun 2020 serta adanya penerapan kebijakan para Gubernur, Walikota dan kabupaten diwilayah masing – masing akankah dapat melindungi para pelaku bisnis serta penilaian para pakar hukum setelah keppres No. 12 Tahun 2020 diterbitkan sangat bertentangan satu pakar hukum dan satu pakar hukum lainnya, bagaimana Dassollen (KUHPerdata Pasal 1245) dan Dassein ( Keppres N0.12 Tahun 2020) terhadap suatu Perjanjian – Keadaan Memaksa / Force Majeure .
