Abstract
Arbitrase merupakan penyelesaian sengketa perkara perdata di luar dari pengadilan umum, berdasarkan perjanjian kedua belah pihak secara tertulis. Perjanjian tersebut memuat isi, bahwa jika terjadi suatu sengketa, khususnya sengketa kepailitan antara para pihak terkait, mereka sepakat untuk menyelesaikan masalahnya pada Lembaga Arbitrase. Perihal sengketa kepailitan yang dimuat dalam klausula arbitrase tersebut, tidak dapat diselesaikan melalui Pengadilan Niaga. Berdasarkan hal tersebut maka yang menjadi permasalahan adalah Kedudukan dan kekuatan Klausula arbitrase dalam perkara kepailitan? dan Sikap Lembaga Pengadilan dalam menyikapi permasalahan Klausula arbitrase? Metode penelitian yang penulis gunakan yaitu yuridis normatif, dimana penelitian ini dilakukan dengan melihat pada penerapan pasal dalam UU Arbitrase yang dinilai tidak memiliki kepastian hukum dalam penerapannya. Jenis data yang digunakan penulis dalam penelitian ini adalah data sekunder, yaitu diperoleh dari studi kepustakaan Hasil yang diperoleh dari penelitian ini yaitu jika terjadi sengketa yang memuat klausula arbitrase harus diselesaikan melalui BANI sesuai perjanjian arbitrase. Hal ini diatur dalam Pasal 3, Pasal 7, dan Pasal 11 UU Arbitrase. Ketentuan-ketentuan tersebut menjelaskan, bahwa Pengadilan Negeri tidak berwenang mengadili sengketa para pihak yang terikat dalam suatu perjanjian arbitrase, dan klausula dalam perjanjian arbitrase tersebut, dianggap telah meniadakan hak para pihak terkait untuk mengajukan penyelesaian sengketa atau beda pendapat ke Pengadilan Negeri./ Arbitration is the settlement of disputes in civil cases outside the general court and is based on a written agreement between the two parties. The agreement includes the content, that if there is a dispute, particularly a bankruptcy dispute between the parties involved, they agree to decipher the problem at the Arbitration Institution. Regarding the bankruptcy dispute comprised in the arbitration clause, it cannot be resolved through the Commercial Court. Based on this description, the problem is the position? and resilience of the arbitration clause in bankruptcy cases, as well as the disposition of the Court Institution in handling the issue of arbitration clauses? The research method that the author uses is normative juridical, where this research is carried out by looking at the application of the articles in the Arbitration Law which are assessed to have no legal certainty in their application. The type of data used by the author in this study is secondary data, which is obtained from a literature study. The results attained from this study are, if there is a dispute that contains an arbitration clause, then the case must be resolved through BANI according to the arbitration agreement. This is regulated in Article 3, Article 7, and Article 11 of the Arbitration Law. These provisions explain that the District Court is not authorized to adjudicate the disputes of the parties bound in an arbitration agreement, and the clauses in the arbitration agreement are deemed to have nullified the rights of the parties concerned to submit dispute resolutions or differences of statement to the District Court
