Judul Skripsi : Perlindungan Hukum Terhadap Pembeli Beritikad Baik dalam Sengketa Jual Beli Tanah (Studi Kasus: Putusan No. 198/Pdt.G/2016/PN.Jkt.Tim) D. Ringkasan Isi : Tanah berperan penting dalam aspek kehidupan bermasyarakat dan bernegara, sebab setiap segi kehidupan manusia berhubungan dengan tanah. Peralihan hak atas tanah melalui jual beli dapat memenuhi kebutuhan atas tanah. Dalam praktik banyak menimbulkan sengketa, terutama mengenai masalah itikad baik yang menjadi pokok permasalahan dalam dunia jual beli tanah di Indonesia. Tujuan penelitian mengetahui penerapan itikad baik dalam proses jual beli tanah dan perlindungan hukumnya. Metode penelitian ini adalah penelitian yuridis normatif dengan pendekatan undang-undang. Sumber data diperoleh dari data sekunder. Data kualitatif dianalisis menggunakan metode analisis deskriptif. Hasil penelitian, tidak ada aturan khusus mengenai itikad baik. Namun Yurisprudensi dan SEMA No. 4 Tahun 2016 dapat mengisi kekosongan hukum untuk menjaga kesatuan dan konsistensi penerapan hukum mengenai perlindungan terhadap pembeli yang memiliki itikad baik dalam jual beli tanah. Jual beli tanah dalam putusan No. 198/Pdt.G/2016/PN.Jkt.Tim adalah sah karena dilakukan di hadapan Notaris. Maka, adanya Akta Autentik memiliki kekuatan pembuktian yang sempurna sehingga pembeli mendapat kepastian hukum. Pembeli sebagai pemilik sah, namun yang beralih hanya kekuasaan atas tanah (feitelijk levering) karena hak atas tanah secara yuridis baru beralih ketika dilakukan pendaftaran sesuai hukum pertanahan nasional Indonesia yang menganut sistem publikasi negatif bertendensi positif. Summary : Land is such a crucial thing in the social aspect of life and state since every aspect of life relates to land. The transition of land rights within sale and purchase can fulfill the needs of land. In practice, it shows disputes, especially relates to good-faith problem, which is becoming the main problem of sale and purchase in Indonesia. This research aims to know the good-faith implementation in land sale and purchase process and knows how to give the legal protection. This research type is a juridical normative method with statute approach, whose source is obtained from secondary data. The qualitative data is analyzed with the descriptive analysis method. As a result, there is no specific law in good faith. However, Jurisprudence and SEMA No. 4 Year 2016 can fill the legal vacuum to maintain the unity and consistency of applying the law regarding buyers' protection with good faith in land sale and purchase. Sale and purchase of land in decision No. 198/Pdt.G/2016/PN.Jkt.Tim is legal because it is carried out before a notary. Thus, the existence of an Authentic Deed has perfect evidentiary power to get legal certainty. The buyer is the legal owner, but it only has the transferred power over the land (feitelijk levering) because the juridical rights of land are only transferred when the registration of land rights is carried out under the national law on land in Indonesia, which adopts a negative publication system with a positive tendency.
