Abstract

Studi ini mengangkat suatu kasus dari satu Putusan Mahkamah Konstitusi tentang Judicial Review terhadap UU No. 37 Tahun 2004 Tentang Kepailitan dan PKPU. Dimana sekitar bulan desember tepatnya pada tahun 2021 telah dilaksanakan uji material (judicial review) oleh Mahkamah Konstitusi yang dimohonkan oleh Pihak PT Sarana Yeoman Sembada selaku pemohon. Adapun yang menjadi objek pengujian pihak pemohon yaitu Pasal 235 ayat (1) dan Pasal 293 ayat (1) UU 37/ 2004 Tentang PKPU. Adapun rumusan masalah dalam skripsi ini yaitu: (1) Bagaimana akibat hukum Putusan MK No.:23/PUU/XIX/2021 terhaadap esensi Lembaga PKPU di Indonesia mengikuti prinsip kepastian hukum UU No. 37 Tahun 2004? dan (2) Apakah Putusan MK No.:23/PUU/XIX/2021 telah mencerminkan prinsip keadilan mengikuti Pasal 28 D ayat (1) UUD 1945?. Mengikuti jenis penelitian yuridis normatif yang dipergunakan, maka bahan hukum yang dipergunakan bersumber dari data sekunder. Data sekunder adalah data yang diperoleh dari studi kepustakaan dengan metode membaca, mengutip, menyalin dan menganalisis asas-asas hukum, teori-teori hukum, doktrin, peraturan yang berlaku. Akibat Hukum Putusan MK No.:23/PUU/XIX/2021 Terhadap Esensi Lembaga PKPU di Indonesia Mengikuti Prinsip Kepastian Hukum UU No. 37 Tahun 2004 yaitu Putusan Permohonan UU tersebut dimana Majelis Hakim dalam amar putusannya mengabulkan Upaya Hukum Kasasi dan Peninjauan Kembali terhadap perkara PKPU yang berlandaskan Prinsip yang tertuang pada Pasal 28 D ayat (1) UUD 1945. Pada perihal ini setelah dikaitkan dengan kepastian hukum dan keadilan hukum, maka penulis beranggapan bahwa Putusan tersebut malah berlawanan terhadap prinsip keadilan dan kepastian hukum. Kaitan Antara Prinsip Keadilan (Pasal 28 D Ayat (1) UUD 1945 Dengan Putusan MK No.. 23/PUU/XIX/2021) yaitu Mahkamah menyatakan telah ternyata Pasal 235 ayat (1) dan Pasal 293 ayat (1) UU 37/2004 telah terbukti menimbulkan ketidakadilan dan ketidakpastian sesuai Pasal 28D ayat (1) UUD 1945. Kata Kunci: Kepastian Hukum, Kepailitan / This study raises a case from a Constitutional Court Decision regarding Judicial Review of Law Number 37 of 2004 concerning Bankruptcy and Suspension of Obligations for Payment of Debt. Where around December to be precise in 2021 a judicial review was carried out by the Constitutional Court which was requested by PT Sarana Yeoman Sembada as the applicant. As for the object of testing by the applicant, namely Article 235 paragraph (1) and Article 293 paragraph (1) of Law 37/2004 concerning PKPU. The formulation of the problem in this thesis is: (1) What are the legal consequences of the Constitutional Court Decision Number: 23/PUU/XIX/2021 on the essence of PKPU Institutions in Indonesia in accordance with the principle of legal certainty in Law Number 37 of 2004? and (2) Does the Constitutional Court Decision Number: 23/PUU/XIX/2021 reflect the principle of justice in accordance with Article 28 D paragraph (1) of the 1945 Constitution?. In accordance with the type of normative juridical research used, the legal materials used are sourced from secondary data. Secondary data is data obtained from literature studies by reading, quoting, copying and analyzing legal principles, legal theories, doctrines, and applicable regulations. The Legal Consequences of the Constitutional Court's Decision Number: 23/PUU/XIX/2021 Against the Essence of PKPU Institutions in Indonesia In accordance with the Principle of Legal Certainty Law Number 37 of 2004, namely the Decision on the Application for the Law where the Panel of Judges in its decision granted Cassation and Review Legal Efforts Returning to the PKPU case which is based on the principles contained in Article 28 D paragraph (1) of the 1945 Constitution. In this case, after being linked to legal certainty and legal justice, the authors assume that the decision is contrary to the principles of justice and legal certainty. The link between the Principles of Justice (Article 28 D Paragraph (1) of the 1945 Constitution and the Decision of the Constitutional Court Number. 23/PUU/XIX/2021), namely that the Court declared that it had turned out that Article 235 paragraph (1) and Article 293 paragraph (1) of Law 37/2004 had proven to cause injustice and uncertainty as referred to in Article 28D paragraph (1) of the 1945 Constitution.
