Abstract

Kekerasan dalam rumah tangga (KDRT) di Indonesia menunjukkan peningkatan signifikan dengan 330.097 kasus pada tahun 2024, meningkat 14,17 persen dari tahun sebelumnya. Battered Women Syndrome (BWS) sebagai kondisi psikologis korban kekerasan domestik berulang menimbulkan dilema yuridis ketika korban melakukan pembelaan diri yang mengakibatkan cedera atau kematian pelaku. Rumusan masalah dalam skripsi ini adalah bagaimana konstruksi normatif Pasal 34 dan 43 UU No. 1 Tahun 2023 tentang KUHP dalam mengakomodasi BWS sebagai alasan penghapusan pidana, dan bagaimana perbandingan normatif pengaturan BWS dalam sistem hukum pidana Indonesia dengan Jerman. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, kasus, historis, dan perbandingan. Data yang digunakan adalah bahan hukum primer berupa KUHP, KUHAP, UU PKDRT, Strafgesetzbuch (StGB) Jerman, dan PERMA No. 3 Tahun 2017, bahan hukum sekunder dari literatur hukum pidana dan jurnal ilmiah, serta bahan hukum tersier berupa kamus hukum, yang kemudian dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa Pasal 34 UU No. 1 Tahun 2023 tidak memadai dalam mengakomodasi korban Battered Women Syndrome (BWS) karena mensyaratkan “serangan seketika” yang tidak sejalan dengan karakter BWS yang kronis dan berulang, sedangkan Pasal 43 secara normatif telah memadai tanpa amandemen legislatif karena unsur “keguncangan jiwa yang hebat” dapat ditafsirkan secara kontekstual berdasarkan PERMA No. 3 Tahun 2017. Perbandingan dengan hukum pidana Jerman menunjukkan bahwa meskipun BWS tidak diatur secara eksplisit, sistem Jerman memiliki kapasitas akomodasi normatif yang lebih kuat, sehingga pengakuan BWS di Indonesia harus diposisikan sebagai dasar penilaian proporsionalitas pertanggungjawaban pidana, bukan pembebasan otomatis./ Domestic violence in Indonesia has shown a significant increase, with 330,097 cases recorded in 2024, representing a 14.17 percent rise from the previous year. Battered Women Syndrome (BWS), as a psychological condition experienced by victims of repeated domestic violence, creates a juridical dilemma when victims resort to self-defense resulting in injury or death of the perpetrator. This thesis examines the normative construction of Articles 34 and 43 of Law No. 1 of 2023 on the Criminal Code in accommodating BWS as a ground for exemption from punishment, and compares the normative regulation of BWS in the Indonesian criminal law system with that of Germany. This research employs normative legal research using statute, conceptual, case, historical, and comparative approaches. The data consist of primary legal materials, including the Criminal Code, the Criminal Procedure Code, the Law on the Elimination of Domestic Violence, the German Strafgesetzbuch (StGB), and Supre me Court Regulation No. 3 of 2017, supported by secondary and tertiary legal materials analyzed qualitatively. The findings of this study indicate that Article 34 of Law No. 1 of 2023 is inadequate to accommodate victims of Battered Women Syndrome (BWS) due to its requirement of an “immediate attack,” which is inconsistent with the chronic and repetitive nature of BWS, whereas Article 43 is normatively sufficient without legislative amendment, as the element of “severe mental disturbance” ay be interpreted contextually in accordance with Supreme Court Regulation No. 3 of 2017. A comparison with German criminal law demonstrates that although BWS is not explicitly regulated, the German legal system possesses a stronger normative capacity to accommodate such cases; therefore, the recognition of BWS in Indonesia should function as a basis for assessing the proportionality of criminal liability rather than as an automatic ground for exculpation.
