Abstract

F. Kata Kunci : Perlindungan Hukum, Perempuan, Kekerasan Berbasis Gender Online, KBGO, UU TPKS, Berdasarkan UU TPKS G. Ringkasan isi : Perkembangan teknologi digital melahirkan kekerasan baru terhadap perempuan dalam bentuk Kekerasan Berbasis Gender Online (KBGO). Data Komnas Perempuan 2024 menunjukkan peningkatan 40,8% dengan 1.791 kasus, sementara SAFEnet mencatat rata-rata lebih dari enam kasus per hari pada 2025. Penelitian ini menganalisis perlindungan hukum terhadap perempuan korban KBGO berdasarkan UU Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual (UU TPKS) dan mengkaji mekanisme pembuktiannya dalam sistem peradilan pidana. Rumusan masalah dalam skripsi ini adalah bagaimanakah perlindungan hukum terhadap perempuan korban KBGO berdasarkan UU TPKS dan bagaimanakah alat bukti terhadap perempuan korban KBGO dalam sistem UU TPKS. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan konseptual, menganalisis bahan hukum primer, sekunder, dan tersier secara yuridis kualitatif. Hasil penelitian menunjukkan perlindungan hukum korban KBGO diatur dalam Pasal 4 ayat (2) jo. Pasal 14 jo. Pasal 66-73 UU TPKS dengan ancaman pidana dalam Pasal 14 huruf i jo. Pasal 15 dan Pasal 5 jo. Pasal 14 jo. Pasal 11. UU TPKS memberikan perlindungan komprehensif berperspektif korban melalui pengakuan Kekerasan Seksual Berbasis Elektronik, penjaminan hak korban, dan sanksi tegas. Mekanisme pembuktian mengadopsi prinsip victim-centered justice dengan mengakui alat bukti elektronik sesuai Pasal 5 UU TPKS yang merujuk UU ITE, menggunakan sistem negatief wettelijk yang mensyaratkan minimum dua alat bukti sah dan keyakinan hakim, serta memberikan perlindungan khusus korban dalam proses pembuktian. \ . Summary: The development of digital technology has given rise to new forms of violence against women in the form of Online Gender-Based Violence (OGBV). Data from the National Commission on Violence Against Women (Komnas Perempuan) for 2024 shows a 40.8% increase with 1,791 cases, while SAFEnet recorded an average of more than six cases per day in 2025. This research analyzes the legal protection for women victims of OGBV based on Law Number 12 of 2022 concerning the Criminal Act of Sexual Violence (UU TPKS) and examines the evidentiary mechanisms within the criminal justice system. The problem formulation in this thesis addresses two key questions: first, how does the UU TPKS provide legal protection for women victims of OGBV, and second, what constitutes admissible evidence for women victims of OGBV under the UU TPKS framework. This research employs a normative legal method with statutory and conceptual approaches, analyzing primary, secondary, and tertiary legal materials through qualitative juridical analysis. The research findings indicate that legal protection for OGBV victims is regulated under Article 4 paragraph (2) in conjunction with Article 14 and Articles 66-73 of the Sexual Violence Criminal Act Law, with criminal sanctions specified in Article 14 letter i in conjunction with Article 15 and Article 5 in conjunction with Article 14 and Article 11. The Sexual Violence Criminal Act Law provides comprehensive victim-centered protection through the recognition of Electronic-Based Sexual Violence, guaranteeing victims' rights, and imposing strict sanctions. The evidentiary mechanism adopts the principle of victim-centered justice by acknowledging electronic evidence in accordance with Article 5 of the Sexual Violence Criminal Act Law, which refers to the Electronic Information and Transactions Law. The law employs a negative statutory evidence system that requires a minimum of two valid pieces of evidence and the judge's conviction, while providing special protection for victims throughout the evidentiary process.
