Abstract

Esports telah diakui sebagai cabang olahraga prestasi, namun perlindungan hukum bagi atlet dalam perjanjian kerja dengan tim esports masih belum optimal. Rumusan masalah penelitian ini adalah kedudukan hukum dan bentuk perlindungan hukum bagi atlet esports dalam perjanjian kerja. Penelitian hukum normatif ini menggunakan pendekatan perundangundangan dan pendekatan konsep. Data sekunder dianalisis secara preskriptif dengan Teori Perlindungan Hukum dan Teori Kepastian Hukum. Hasil penelitian menyimpulkan bahwa perjanjian antara atlet esports dan tim esports dapat berkedudukan sebagai perjanjian kerja apabila secara faktual memenuhi unsur pekerjaan, upah, dan perintah sebagaimana diatur dalam hukum ketenagakerjaan. Perlindungan hukum bersifat preventif dan represif, namun efektivitasnya masih terkendala pengawasan dan kesadaran hukum. Kata Kunci : Perlindungan Hukum, Atlet Esports, Perjanjian Kerja. / Esports has been recognized as a competitive sport, yet legal protection for athletes in employment agreements with esports teams remains suboptimal. The research problems are the legal position and forms of legal protection for esports athletes in employment agreements. This normative legal research employs statute and conceptual approaches. Secondary data were analyzed prescriptively using the Legal Protection Theory and the Legal Certainty Theory. The findings conclude that agreements between esports athletes and esports teams may qualify as employment agreements if they factually fulfill the elements of work, wages, and command under labor law. Legal protection is preventive and repressive, yet its effectiveness remains hindered by weak supervision and legal awareness. Keywords : Legal Protection, Esports Athletes, Employment Agreement.
