Ringkasan Isi : Penelitian ini bertujuan untuk mengkaji Putusan Nomor 438/Pid.Sus/2020/PN.Jkt.Utr dan membahas mengenai prosedur dan etika penagihan debt collector fintech. Maraknya penggunaan pinjaman online fintech dalam masyarakat untuk memenuhi kebutuhannya seringkali menimbulkan dinamika sosial dalam kehidupan masyarakat, salah satunya yaitu permasalahan debt collector dalam menjalankan tugasnya yaitu penagihan kepada debitor yang mengalami permasalahan dalam pembayaran seringkali melakukan perbuatan-perbuatan yang melanggar ketentuan hukum pidana sehingga menimbulkan keresahan dalam masyarakat. Penelitian ini akan membahas mengenai bagaimana ketentuan hukum yang mengatur prosedur penagihan debt collector fintech, dan membahas juga mengenai pertimbangan hakim dalam memutus perkara nomor 438/Pid.Sus/2020/PN.Jkt.Utr. Penelitian ini berfokus kepada kepastian hukum mengenai ketentuan hukum bagi pinjaman online dan debt collector fintech. Metode penelitian yang digunakan oleh penulis dalam penelitian ini yaitu yudridis normatif, yang akan membahas terkait etika dan prosedur penagihan debt collector fintech, yaitu berdasarkan peraturan perundang-undangan, literasi, jurnal, dan pendapat dari para ahli. Pada penelitian ini, penulis menggunakan data sekunder sebagai sumber penelitiannya yang berupa peraturan perundang-undangan, putusan pengadilan, buku, jurnal, dan sejenisnya. Hasil dari penelitian ini menunjukkan bahwa adanya peraturan perundang-undangan yang mengatur mengenai etika dan prosedur penagihan debt collector secara spesifik dan jelas sangat diperlukan untuk dapat memenuhi kepastian hukum, juga untuk mencegah debt collector melakukan perbuatan yang melanggar ketentuan hukum pidana dan hak asasi manusia dalam melakukan penagihan kepada nasabah. Selain itu, untuk mempermudah penindakan terhadap debt collector yang melakukan tindak pidana maupun pelanggaran hak asasi manusia dalam melakukan penagihan, peraturan mengenai penegakan hukum bagi debt collector juga perlu diatur dalam ketentuan undang-undang. Summary : This study aims to examine Court Decision Number 438/Pid.Sus/2020/PN.Jkt.Utr and to analyze the procedures and ethical standards applied in the debt collection practices carried out by fintech debt collectors. The increasing use of fintech-based online loans by the public to fulfill their financial needs has frequently given rise to various social dynamics. One such issue concerns the practices of debt collectors who, in carrying out their duties to collect payments from debtors experiencing financial difficulties, often engage in actions that violate the provisions of criminal law, thereby causing public anxiety and unrest. This research will specifically explore the legal provisions that regulate the procedures for debt collection by fintech debt collectors, as well as examine the judicial considerations taken into account in the adjudication of case number 438/Pid.Sus/2020/PN.Jkt.Utr. The primary focus of this study is the legal certainty regarding the regulatory framework governing online loans and fintech debt collection activities. The research method employed in this study is normative juridical research, which will examine the ethical considerations and procedural requirements of fintech debt collection practices. This analysis will be based on statutory regulations, scholarly literature, academic journals, and expert opinions. In conducting this research, the author utilizes secondary data sources consisting of statutory laws and regulations, court decisions, books, academic journals, and other relevant legal materials. The result of this study show that the existence of clear and specific statutory regulations governing the ethics and procedures of debt collection is crucial for ensuring legal certainty. Such regulations are also necessary to prevent debt collectors from committing acts that violate criminal law provisions and human rights during the debt collection process. Furthermore, in order to facilitate legal action against debt collectors who commit criminal offenses or human rights violations in the course of debt collection activities, the enforcement provisions applicable to debt collectors must also be explicitly regulated by law H.
