Abstract

Perlindungan rahasia dagang merupakan komponen penting dalam rezim kekayaan intelektual yang strategis untuk menjaga daya saing perusahaan, khususnya dalam hubungan ketenagakerjaan di mana pekerja memiliki akses terhadap informasi rahasia bernilai ekonomi. Penelitian ini menganalisis hubungan antara Undang-Undang Nomor 30 Tahun 2000 mengenai Rahasia Dagang dengan pencantuman klausul non-kompetisi dalam perjanjian kerja dan mengkaji pertimbangan hakim dalam Putusan Nomor 520/PDT/2020/PT SMG terkait penerapannya. Studi menggunakan metode hukum normatif melalui pendekatan peraturan perundang-undangan dan studi kasus. Data bersumber dari bahan hukum primer, sekunder, dan tersier yang dianalisis menggunakan pendekatan kualitatif. Temuan studi mengindikasikan meskipun klausul non-kompetisi tidak diatur secara eksplisit dalam UU Nomor 30 Tahun 2000, klausul tersebut dapat berfungsi sebagai instrumen perlindungan rahasia dagang sepanjang tidak bertentangan dengan hukum ketenagakerjaan serta UUD 1945. Pertimbangan hakim menekankan pentingnya keseimbangan antara perlindungan kepentingan bisnis perusahaan dan jaminan hak konstitusional pekerja dengan mempertimbangkan prinsip proporsionalitas yang mencakup durasi, cakupan geografis, dan kompensasi yang wajar. Kesimpulannya bahwa penerapan klausul non-kompetisi dalam perjanjian kerja untuk melindungi rahasia dagang harus memenuhi ketentuan Pasal 1320 KUHPerdata serta tidak boleh bertentangan dengan hak konstitusional pekerja. / The protection of trade secrets constitutes an essential component of the intellectual property regime and serves as a strategic mechanism to maintain corporate competitiveness, particularly within employment relationships where employees have access to confidential information of economic value. This study examines the relationship between Law Number 30 of 2000 on Trade Secrets and the inclusion of non-competition clauses in employment contracts, as well as analyzes judicial considerations in Decision Number 520/PDT/2020/PT SMG concerning their implementation. This research employs a normative legal method using a statutory approach and a case study approach. The data were obtained through library research on primary, secondary, and tertiary legal materials, which were subsequently analyzed qualitatively. The findings indicate that although non-competition clauses are not explicitly regulated under Law Number 30 of 2000, such clauses may function as instruments for the protection of trade secrets provided that they do not contravene labor law provisions and the 1945 Constitution of the Republic of Indonesia. The court’s considerations emphasize the importance of balancing the protection of corporate business interests with the guarantee of employees’ constitutional rights, taking into account the principle of proportionality, including the duration, geographical scope, and reasonable compensation.In conclusion, the enforceability of non-competition clauses in employment contracts as a means of protecting trade secrets must fulfill the legal requirements of a valid agreement as stipulated in Article 1320 of the Indonesian Civil Code and must not contravene workers’ constitutional right to work.
