Abstract

Penelitian ini ditujukan untuk menganalisis kebijakan Pemerintah Kabupaten Merauke dalam tata kelola penjualan minuman keras serta meninjau efektivitas penegakan hukum terhadap pelanggaran yang terjadi. Fokus penelitian mencakup kesesuaian regulasi dengan peraturan perundang-undangan dan prinsip hukum yang berlaku. Selain itu, penelitian ini juga bertujuan untuk mengidentifikasi hambatan serta memberikan rekomendasi guna meningkatkan efektivitas kebijakan tersebut. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Data yang digunakan merupakan data sekunder dari studi kepustakaan, meliputi peraturan perundangundangan, jurnal ilmiah, serta laporan resmi terkait. Teori yang digunakan mencakup teori negara hukum, teori tujuan hukum, dan teori sistem hukum untuk menganalisis implementasi kebijakan serta efektivitas penegakan hukum di Kabupaten Merauke. Hasil penelitian menunjukkan bahwa tata kelola penjualan minuman keras telah sesuai dengan ketentuan hukum, tetapi masih menghadapi tantangan dalam implementasi akibat faktor sosial dan budaya masyarakat. Oleh karena itu, diperlukan penguatan kesadaran hukum, edukasi masyarakat, serta peningkatan koordinasi antara pemerintah dan aparat penegak hukum. Dalam penegakan hukum, prinsip kepastian hukum yang adil serta pendekatan ultimum remedium dan keadilan restoratif harus diterapkan guna mencapai keseimbangan antara kepastian hukum, kemanfaatan, dan perlindungan masyarakat / This study aims to analyze the policies of the Merauke Regency Government in managing the sale of alcoholic beverages and to examine the effectiveness of law enforcement against violations. The focus of this research includes the compliance of regulations with applicable laws and legal principles. Additionally, this study seeks to identify obstacles and provide recommendations to enhance the effectiveness of these policies. The research method used is normative juridical with statutory and conceptual approaches. The data utilized are secondary data obtained from literature studies, including statutory regulations, scientific journals, and official reports. The theories used include the rule of law theory, the purpose of law theory, and the legal system theory to analyze policy implementation and the effectiveness of law enforcement in Merauke Regency. The results show that the management of alcoholic beverage sales complies with legal provisions but still faces implementation challenges due to social and cultural factors. Therefore, strengthening legal awareness, educating the public, and improving coordination between the government and law enforcement agencies are necessary. In law enforcement, the principle of fair legal certainty, along with the ultimum remedium approach and restorative justice, must be applied to achieve a balance between legal certainty, benefits, and public protection.
