Abstract

Skripsi ini, berjudul "Tinjauan Hukum Perdata terhadap Penarikan Paksa Kendaraan Jaminan Fidusia Berdasarkan Putusan Nomor 9/PDT/2017/PT. KALBAR," bertujuan untuk melakukan analisis hukum perdata terhadap penarikan paksa kendaraan yang dijaminkan melalui fidusia, merujuk pada putusan pengadilan khusus. Metode penelitian yang diterapkan adalah yuridis normatif dengan pendekatan perundang-undangan dan kasus hukum. Data yang digunakan berasal dari bahan hukum primer dan sekunder, termasuk undang-undang, putusan pengadilan, dan literatur hukum terkait. Hasil penelitian menunjukkan bahwa putusan Nomor 9/PDT/2017/PT. KALBAR menjadi dasar hukum penarikan paksa kendaraan jaminan fidusia. Analisis hukum perdata terhadap putusan tersebut menyoroti aspek-aspek hukum yang menjadi dasar penarikan paksa, serta implikasinya terhadap pihak yang terlibat. Dalam konteks pembelaan terpaksa, penelitian ini juga mengevaluasi batasan-batasan dalam penarikan paksa dan dampaknya terhadap hak-hak konsumen. Harapannya, penelitian ini memberikan kontribusi pemikiran dan informasi relevan mengenai penarikan paksa kendaraan jaminan fidusia, serta memperdalam pemahaman implikasi hukum dari putusan tersebut dalam lingkup hukum perdata"/"This thesis, titled "Civil Law Review of Forced Repossession of Vehicles with Fiduciary Guarantee Based on Decision Number 9/PDT/2017/PT. KALBAR," aims to conduct a civil law analysis of the forced repossession process of vehicles secured through fiduciary, referring to a specific court decision. The research method employed is a normative juridical approach with legal provisions and case law. Data sources include primary and secondary legal materials, such as laws, court decisions, and relevant legal literature. The research findings indicate that Decision Number 9/PDT/2017/PT. KALBAR serves as the legal basis for the forced repossession of vehicles with fiduciary guarantees. The civil law analysis of this decision highlights the legal aspects underlying the forced repossession and its implications for the involved parties. In the context of forced defense, this study also evaluates the limitations in forced repossession and its impact on consumer rights. The hope is that this research contributes valuable thoughts and relevant information regarding the forced repossession of vehicles with fiduciary guarantees, as well as deepens the understanding of the legal implications of this decision within the scope of civil law.
