Abstract

Terjadinya Kekerasan Seksual tidak mengenal waktu dan tempat terkhususnya di lingkungan perguruan tinggi, dengan hal tersebutlah pengaturan mengenai pencegahan dan penanganan Kekerasan Seksual harus berkembang mengikuti perkembangan zaman, karena dengan berkembangnya zaman tentunya akan semakin banyak jenis dan bentuk kekerasan seksual itu sendiri, rumusan masalah dalam skripsi ini adalah bagaimana pengaturan pencegahan dan penanganan Kekerasan Seksual memenuhi unsur untuk memberikan perlindungan hukum kepada korban Kekerasan Seksual dalam isi peraturan itu sendiri. Metode penelitian yang digunakan adalah normatif. penelitian hukum normatif menggunakan analisis data kualitatif untuk menganalisis peraturan pencegahan dan penanganan Kekerasan Seksual di lingkungan perguruan tinggi serta untuk mengevaluasi implementasi dari peraturan yang ada di Universitas Kristen Indonesia berdasarkan Peraturan Rektor dan Keputusan Rektor dengan tambahan wawancara eksklusif dengan Satgas PPKS UKI dari unsur tenaga pendidik untuk melengkapi data penelitian ini. Dalam Pencegahan dan Penanganan Kekerasan Seksual Pengaturannya masih terdapat unsur ketidakpastian dalam isinya, untuk memastikan perlindungan hukum, diperlukan peraturan yang isinya jelas, konsisten. Implementasi di UKI mengenai pencegahan dan penanganan Kekerasan Seksual masih dilanda oleh kurangnya kesadaran dan pengetahuan oleh warga kampusnya sendiri. / The occurrence of sexual violence knows no time or place, especially in the university environment. Therefore, regulations regarding the prevention and handling of sexual violence must evolve with the times, as the types and forms of sexual violence will inevitably increase with the passage of time. The research question in this thesis is how the regulations for preventing and handling sexual violence meet the elements necessary to provide legal protection to victims of sexual violence within the content of the regulations themselves. The research method employed in this study is normative legal research. Normative legal research utilizes qualitative data analysis to examine the regulations governing the prevention and handling of Sexual Violence within higher education institutions, as well as to evaluate the implementation of these regulations at the Universitas Kristen Indonesia, based on the Rector’s Regulation and Rector’s Decree. In addition, exclusive interviews with members of the Satgas PPKS UKI from the academic staff element were conducted to complement and enrich the research data. In the regulation concerning the Prevention and Handling of Sexual Violence, there remain elements of legal uncertainty within its provisions. To ensure effective legal protection, it is essential to establish regulations that are clear and consistent in substance. The implementation of the prevention and handling of Sexual Violence at UKI continues to face challenges due to the lack of awareness and understanding among members of the university community themselves.
