Abstract

Perdagangan manusia adalah kejahatan berat yang mengeksploitasi korban dan melanggar hak asasi manusia. Undang-Undang TPPO Nomor 21 Tahun 2007 di Indonesia mengatur kejahatan ini dalam rangka melindungi korban dan menindak pelakunya. Penelitian ini membahas penerapan aturan terkait dan perlindungan hukum terhadap korban berdasarkan Putusan Nomor 211/Pid.Sus/2021/PN.Dps.. Dalam penelitian ini digunakan metode yuridis normatif dengan pendekatan studi kasus terhadap putusan pengadilan. Hasil penelitian menunjukkan bahwa meskipun UU TPPO telah mengatur hak-hak korban, implementasi perlindungan hukum masih mengalami kendala, seperti kurangnya akses korban terhadap rehabilitasi, perlindungan, dan pemulihan psikologis. Selain itu, terdapat perbedaan antara tuntutan jaksa dan vonis hakim yang menunjukkan adanya disparitas dalam penegakan hukum terhadap pelaku perdagangan orang. Temuan ini menegaskan perlunya peningkatan koordinasi antara lembaga penegak hukum, pemerintah, dan organisasi masyarakat dalam menangani korban perdagangan orang. Penguatan mekanisme perlindungan, pemberian kompensasi, serta penegakan hukum yang lebih tegas menjadi langkah yang perlu dioptimalkan. Studi ini diharapkan dapat memberikan kontribusi bagi perbaikan sistem perlindungan hukum bagi korban perdagangan orang di Indonesia. / Human trafficking is a serious crime that violates human rights and leads to the exploitation of victims. In Indonesia, this crime is regulated under Law Number 21 of 2007 concerning the Eradication of Human Trafficking Crimes (UU TPPO), which aims to provide legal protection for victims and impose strict sanctions on perpetrators. This study examines the legal protection afforded to trafficking victims, focusing on the implementation of these protections in light of Verdict Number 211/Pid.Sus/2021/PN.Dps. This research employs a normative juridical method with a case study approach to judicial decisions. The findings indicate that while the UU TPPO establishes victims' rights, challenges persist in its implementation, including limited access to rehabilitation, protection, and psychological recovery. Additionally, disparities between prosecutorial demands and judicial sentencing highlight inconsistencies in the enforcement of human trafficking laws. These findings underscore the need for enhanced coordination among law enforcement agencies, government institutions, and civil society organizations in addressing human trafficking victims' rights. Strengthening protection mechanisms, ensuring adequate compensation, and enforcing stricter legal measures are crucial steps toward optimizing victim support. This study aims to contribute to the improvement of Indonesia’s legal framework for human trafficking victim protection.
