Abstract

Perlindungan pekerja migran perempuan Indonesia yang bekerja di sektor domestik merupakan bagian dari kewajiban negara untuk menghormati, melindungi, dan memenuhi hak asasi manusia sebagaimana diatur dalam instrumen hukum internasional seperti Konvensi ILO No. 143, Konvensi ILO No. 189, Protokol Palermo. Rumusan masalah dalam penelitian ini adalah bagaimana pelaksanaan hukum internasional dalam perlindungan terhadap pekerja migran perempuan Indonesia di sektor domestik dan bagaimana bentuk tanggung jawab negara dalam kasus pelanggaran hak pekerja migran berdasarkan studi kasus Adelina Lisao. Penelitian ini menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Data yang digunakan berupa data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier, yang dianalisis secara normatif kualitatif. Hasil dari penelitian ini menunjukkan bahwa Indonesia masih memerlukan beberapa perubahan peraturan hukum dalam Undang-Undang No. 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia, dengan spesifik memasukkan perlindungan terhadap pekerja migran illegal yang terjerat perdagangan orang. Dan peraturan Internasional pun perlu diadopsi atau diratifikasi agar dasar perlindungan terhadap korban menjadi lebih kuat dan konkret. Di perlukan juga pengawasan yang lebih ketat oleh negara Malaysia serta pemberian hak keadilan yang pekerja harusnya dapatkan. / The protection of Indonesian female migrant workers employed in the domestic sector is part of the state's obligation to respect, protect, and fulfill human rights, as stipulated in international legal instruments such as ILO Convention No. 143, ILO Convention No. 189, and the Palermo Protocol.This study addresses the issues of how international law is implemented in the protection of Indonesian female migrant workers in the domestic sector, and what form the state’s responsibility takes in cases of rights violations, based on the case study of Adelina Lisao. This research employs a statute approach and a case approach. The data used are secondary data comprising primary, secondary, and tertiary legal materials, which are analyzed using a normative qualitative method. The findings of this research indicate that Indonesia still requires several legal reforms to Law No. 18 of 2017 on the Protection of Indonesian Migrant Workers, specifically to include protection for undocumented migrant workers who are victims of human trafficking. Furthermore, international regulations should be adopted or ratified to provide a stronger and more concrete basis for victim protection. Stricter oversight from the Malaysian government and the provision of justice to which workers are entitled are also necessary.
