Abstract

Perjudian di Indonesia dalam berbagai bentuk akhir-akhir ini semakin marak, baik dari segi kuantitas, maupun dari sistem perjudian itu sendiri. Perjudian ini meresahkan masyarakat Indonesia. Judi sudah meracuni masyarakat luas baik dari kalangan bawah hingga menengah. Selain hal di atas, jika ditinjau dari segi kepentingan nasional, perjudian mempunyai akses yang negatif dan merugikan terhadap moralitas dan mentalitas masyarakat, khususnya para generasi, muda. Oleh karena itu, sangat beralasan jika kemudian kejahatan perjudian harus segera dicarikan cara dan solusi yang rasional untuk menanggulanginya. Terkait dengan banyaknya kasus judi oniine di Jakarta, tersebut dapat diketahui Polda Metro Jaya telah melakukan upaya penegakan hukum terhadap salab satu kasus perjudian online. Dalam penelitian ini penulis, menggunakan metode penelitian hukum normatif. Penelitian normatif merupakan prosedur penelitian ilmiah untuk menemukan kebenaran berdasarkan logika keilmuan hukum dari sisi normatifnya. Logika keilmuan dalam penelitian hukum nonnatif dibangun berdasarkan disiplin ilmiah dan cara-cara kerja i1mu hukum normatif, yaitu ilmu hukum yang objeknya hukum itu sendiri. Berdasarkan hasil penelitian didapatkan kesimpulan bahwa: Pengaturan tindak pidana tindak pidana judi online Menurut UU ITE dan KUHP sebagai berikut. Terdapat beberapa peraturan yang mengatur perihal perjudian, seperti yang diatur dalam Pasal 303 dan Pasal 303 bis KUHP. Kemudian, hukum judi online secara spesifik diatur dalam Pasal 27 ayat (2) UU ITE dan perubahannya. Hambatan hambatan dalam proses penanganan tindak pidana perjudian online di Wilayah Polda Metro Jaya Dalam memberantas tindak pidana perjudian online aparat penegak hukll111 di Wilayah Polda Metro Jaya ban yak mengalami kendala- kendala dalam memberantas perjudian online di Jakarta dianataranya adalah: Faktor Penegak Hukum, Faktor Sarana dan Prasarana Kurangnya prasarana SDM dan Faktor Kebudayaan. / Gambling in Indonesia in various forms has recently become increasingly rampant, both in terms of quantity and the gambling system itself. This gambling is disturbing Indonesian society. It has poisoned society at large, from the lower to the middle classes. Furthermore, from a national interest perspective, gambling has negative and detrimental effects on the morality and mentality of society, especially the younger generation. Therefore, it is reasonable to immediately find rational ways and solutions to combat the crime of gambling. Regarding the numerous online gambling cases in Jakarta, it is known that the Jakarta Metropolitan Police have taken law enforcement measures against one of the online gambling cases. In this research, the author used a normative legal research method. Normative research is a scientific research procedure to discover the truth based on the logic of legal science from a normative perspective. The scientific logic in non-native legal research is based on scientific disciplines and the working methods of normative legal science, namely legal science whose object is law itself. Based on the research results, it was concluded that: The regulation of online gambling crimes according to the ITE Law and the Criminal Code is as follows. There are several regulations governing gambling, as stipulated in Article 303 and Article 303 bis of the Criminal Code. Furthermore, online gambling law is specifically regulated in Article 27 paragraph (2) of the ITE Law and its amendments. Obstacles in handling online gambling crimes in the Metro Jaya Regional Police Area. In eradicating online gambling crimes, law enforcement officers in the Metro Jaya Regional Police Area have encountered many obstacles in eradicating online gambling in Jakarta, including: Law Enforcement Factors, Facilities and Infrastructure Factors, Lack of Human Resources, and Cultural Factors.
