Abstract

Problematika hukum terkait penetapan justice collaborator bagi pelaku utama menimbulkan permasalahan hukum, sebagaimana dikaji dalam Putusan Nomor: 93/Pid.Sus-TPK/2019/PN Jkt.Pst. Putusan ini mempermasalahkan status justice collaborator yang diberikan oleh LPSK dengan persetujuan hakim dan jaksa penuntut umum. Penelitian ini menggunakan metode yuridis normatif dengan menganalisis keputusan pengadilan serta menghubungkannya dengan peraturan-undangan yang relevan. Sumber hukum sekunder seperti undang-undang, kasus hukum, dan pandangan ahli juga digunakan sebagai pendukung data dalam penelitian skripsi ini. Hasil penelitian menunjukkan bahwa putusan pengadilan dalam kasus korupsi ini tidak konsisten dan bertentangan dengan hukum. Berdasarkan Undang-Undang Nomor 13 Tahun 2006 yang telah diubah dengan Undang- Undang Nomor 31 Tahun 2014, justice collaborator tidak boleh diberikan kepada pelaku utama. Namun, dalam kasus ini, Terdakwa II Alfin Suherman tetap diberikan status tersebut. Hal ini bertentangan dengan ketentuan hukum yang berlaku, di mana seorang dalang kejahatan tidak seharusnya menjadi justice collaborator, sehingga ini menjadi suatu problem hukum yang melanggar ketentuan undang-undang.// Legal problems related to the determination of justice collaborators for the main perpetrators cause legal problems, as studied in Decision Number: 93/Pid.Sus-TPK/2019/PN Jkt.Pst. This decision issues the status of justice collaborators given by LPSK with the approval of judges and public prosecutors. This study uses a normative juridical method by analyzing court decisions and relating them to relevant regulations. Secondary legal sources such as laws, legal cases, and expert views are also used as data support in this thesis research. The results of the study show that the court decision in this corruption case is inconsistent and contrary to the law. Based on Law Number 13 of 2006 which has been amended by Law Number 31 of 2014, justice collaborators must not be given to the main perpetrators. However, in this case, Defendant II Alfin Suherman was still given this status. This is contrary to the applicable legal provisions, where a mastermind of a crime should not be a justice collaborator, so this is a legal problem that violates the provisions of the law.
