Abstract

Kasus kepailitan PT Asuransi Jiwa Bumi Asih Jaya masih berlanjut hingga saat ini dan tim kurator belum menunjukkan upaya yang signifikan dalam proses pemberesan kepailitan. Sesuai dengan Pasal 71 huruf (d) Undang-Undang Nomor 31 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang PT. Asuransi Jiwa Bumi Asih Jaya telah mengajukan permohonan kurator pengganti. Penelitian ini menggunakan teori pertanggungjawaban, teori kepastian hukum dan teori kepailitan sebagai kerangka analisis untuk mengkaji isu-isu yang timbul dalam kasus ini. Penelitian ini yaitu yuridis normatif menggunakan data sekunder, sedangkan penelitian yuridis normatif menggunakan metodologi deskriptif analitis. Pendekatan kasus dan pendekatan perundang-undangan digunakan. Pencarian dan pengumpulan dokumen hukum yang relevan dengan permasalahan yang diteliti merupakan metode pengumpulan bahan hukum, serta analisis data kualitatif adalah metode yang digunakan untuk analisis data. Sebagai kreditor preferen, perusahaan asuransi bertanggung jawab atas semua kerugian pemegang polis. Sehubungan dengan kasus pailit PT Asuransi Jiwa Bumi Asih Jaya, Keputusan Nomor 6/Pdt.Sus.Gugatan Lain-Lain-Ap/2020/PN.Niaga.Jkt.Pst, perusahaan tersebut secara hukum bertanggung jawab atas semua kerugian pemegang polis. Tujuan dari penerapan prinsip tanggung jawab mutlak ini adalah untuk menjamin bahwa pemegang polis akan dibayar jika mengalami kerugian. Putusan Nomor 6/Pdt.Sus.Gugatan Lain-Lain-AP/2020/PN.Niaga.Jkt.Pst ini menegaskan bahwa perlindungan hukum terhadap kreditor preferen tidak hanya bergantung pada aturan normatif, tetapi juga pada implementasi yang dilakukan oleh kurator. Pergantian kurator yang bermasalah menunjukkan bahwa pengadilan berperan aktif dalam memastikan integritas dan efektivitas pengelolaan harta pailit. Hal ini sejalan dengan asas keadilan dalam hukum kepailitan, di mana semua pihak yang memiliki hak atas aset debitor dilindungi sesuai dengan prioritas dan prinsip hukum yang berlaku. Kata Kunci: Pergantian Kurator, Pengurusan dan Pemberesan Harta Pailit, PT Asuransi Jiwa Bumi Asih Jaya / The curator team has not yet made a substantial attempt to go forward with the bankruptcy settlement process in the continuing bankruptcy case of PT Asuransi Jiwa Bumi Asih Jaya. As required by Law No. 31 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations, Article 71 letter (d), PT Asuransi Jiwa Bumi Asih Jaya has in this regard sought the curator's replacement. In order to analyse the difficulties raised in this case, this study uses the theories of culpability, insolvency, and bankruptcy as analytical frameworks. A descriptive-analytical specification is used in normative juridical research as the research methodology. The data used is secondary data due to the normative legal character of the study. The two methods used are the case method and the statutory method. Qualitative analysis is the data analysis method used, whereas the method for obtaining legal documents include looking for and gathering pertinent legal resources connected to the topics under study. Based on the principle of strict liability, as stated in Decision No. 6/Pdt.Sus.Gugatan Lain-Lain-Ap/2020/PN.Niaga.Jkt.Pst regarding the bankruptcy case of PT Asuransi Jiwa Bumi Asih Jaya, the research findings indicate that the insurance company's liability towards policyholders as preferential creditors. Regarding PT Asuransi Jiwa Bumi Asih Jaya's debt, the firm is legally obligated to bear full responsibility for the losses suffered by policyholders, without the need to demonstrate any wrongdoing on the insurance company's side. By implementing this strict responsibility approach, policyholders hope to get reimbursement for their losses. Decision Number 6/Pdt.Sus.Other Claims-AP/2020/PN.Niaga.Jkt.Pst confirms that legal protection for preferred creditors does not only depend on normative rules, but also on the implementation carried out by the curator. The replacement of problematic curators shows that the court plays an active role in ensuring the integrity and effectiveness of the management of bankrupt assets. This is in line with the principle of justice in bankruptcy law, where all parties who have rights to the debtor's assets are protected in accordance with the applicable legal priorities and principles.
