Abstract

Putusan dari kasus penganiayaan Dewa Perangin-pangin terhadap korban Sarianto Ginding menjadi dasar dari penulisan ini. Yang mana dari pertimbangan hakim dalam putusan tersebut tidaklah sesuai dengan hukum yang mengatur. Berdasarkan permasalahan tersebut, maka timbullah sebuah pertanyaan terhadap pengaturan sanksi penganiayaan yang menyebabkan kematian yang ditinjau dalam hukum pidana di Indonesia dan yang menjadi pertimbangan Hakim dalam menjatuhkan hukuman terhadap kasus tersebut. Metode penelitian dalam penulisan skripsi ini yaitu menggunakan jenis penelitian yuridis – normatif. / The verdict in the case of the persecution of Dewa Perangin-pangin against the victim Sarianto Ginding is the basis of this paper. Which of the judge's considerations in the decision is not in accordance with the governing law. Based on these problems, a question arises regarding the regulation of sanctions for maltreatment that causes death in terms of criminal law in Indonesia and the consideration of the judge in sentencing the case. The research method in writing this thesis is to use juridical - normative research.
