Abstract

Dalam konteks penanggulangan penangkapan ikan ilegal, kebijakan penenggelaman kapal oleh pemerintah Indonesia sebagai tindakan yurisdiksi untuk memberikan efek jera terhadap pelaku tindak pidana IUU fishing. Selain itu, tindakan penenggelaman kapal ini juga bisa ditinjau dengan hukum internasional. Ada berbagai hukum internasional yang bisa ditinjau dakam tindakan penenggelaman kapal ini. Untuk itu dilakukannya penelitian ini dengan metode deskriptif dan eksplanatori, dimana tujuannya untuk meninjau legalitas penenggelaman kapal asing oleh Indonesia berdasarkan Hukum Internasional antara tahun 2014-2019. Berdasarkan penenggelaman kapal ini tentunya berdampak ke sumber daya laut Indonesia. Ditemukan bahwa penenggelaman kapal asing oleh pemerintah Indonesia sesuai dengan ketentuan hukum internasional yang mengatur hak penegakan hukum di wilayah Zona Ekonomi Eksklusif (ZEE) dan laut teritorial, seperti yang diatur dalam United Nations Convention on the Law of the Sea (UNCLOS) 1982, dan Legalitas penenggelaman kapal oleh pemerintah Indonesia dapat dijustifikasi oleh prinsip-prinsip hukum internasional terkait penegakan kedaulatan negara di sektor perikanan. / In the context of combating Illegal Fishing, the policy of sinking ships by the Indonesian government as a jurisdictional action to provide a deterrent effect on perpetrators of IUU fishing crimes. In addition, this act of sinking ships can also be reviewed under international aw. There are various international aws that can be reviewed in this act of sinking ships. For this reason, this study was conducted using descriptive and explanatory methods, the aim of which was to review the egality of the sinking of foreign ships by Indonesia based on International Law between 2014-2019. Based on the sinking of this ship, it certainly has an impact on Indonesia's marine resources. It was found that the sinking of foreign ships by the Indonesian government was in accordance with the provisions of international Law governing the right to enforce the Law in the Exclusive Economic Zone (EEZ) and territorial seas, as regulated in the United Nations Convention on the Law of the Sea (UNCLOS) 1982, and the egality of the sinking of ships by the Indonesian government can be justified by the principles of international Law related to the enforcement of state sovereignty in the fisheries sector.
