Abstract

Program Jaminan Kesehatan Nasional sampai dengan Desember 2023 telah mencapai cakupan semesta atau Universal Health Coverage (UHC). Makna dari UHC lebih dari sekedar cakupan kepesertaan namun juga pemberian akses terhadap pelayanan kesehatan. Pembaharuan hukum program Jaminan Kesehatan Nasional perlu dilakukan sebagai pelaksanaan amanat konstitusi demi mewujudkan cita-cita memajukan kesejahteraan umum rakyat Indonesia khususnya di era disrupsi melalui implementasi layanan telemedisin. Rumusan masalah dalam skripsi ini ialah 1) bagaimana penyelenggaraan program Jaminan Kesehatan Nasional menurut peraturan perundang-undangan, 2) bagaimana pembaharuan hukum program Jaminan Kesehatan Nasional di era disrupsi dalam pelaksanaan layanan telemedisin. Jenis penelitian dalam skripsi ini adalah penelitian hukum normatif menggunakan pendekatan undang-undang dan konseptual. Disimpulkan bahwa penyelenggaraan program Jaminan Kesehatan Nasional yang diatur dalam UU SJSN dan UU BPJS sejalan dengan teori negara hukum yang dikemukakan oleh Friedrich Julius Stahl. Program Jaminan Kesehatan Nasional pada prinsipnya mengedepankan teori kemanfaatan, layanan telemedisin bermanfaat untuk membuka dan meningkatkan akses layanan kesehatan. Perlu pengaturan secara khusus manfaat telemedisin dalam peraturan perundang-undangan seiring adanya kebijakan dalam Undang-Undang Nomor 17 Tahun 2023 tentang kesehatan terkait telemedisin. / The National Health Insurance Program until December 2023 has achieved Universal Health Coverage (UHC). The meaning of UHC is more than just coverage of membership but also providing access to health services. Legal renewal of the National Health Insurance program needs to be carried out as an implementation of the constitutional mandate in order to realize the ideals of advancing the general welfare of the Indonesian people, especially in the era of disruption through the implementation of telemedicine services. The formulation of the problem in this thesis is 1) how to administer the National Health Insurance program according to statutory regulations, 2) how to update the law on the National Health Insurance program in an era of disruption in the implementation of telemedicine services. The type of research in this thesis is normative legal research using statutory and conceptual approaches. It is concluded that the implementation of the National Health Insurance program regulated in the SJSN Law and the BPJS Law is in line with the rule of law theory put forward by Friedrich Julius Stahl. The National Health Insurance Program in principle puts forward the theory of benefits, telemedicine services are useful for opening and increasing access to health services. It is necessary to specifically regulate the benefits of telemedicine in statutory regulations in line with the policy in Law Number 17 of 2023 concerning health related to telemedicine.
