Abstract
Penelitian ini membahas analisis yuridis terkait pekerja alih daya (outsourcing) ditinjau dari Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja menjadi Undang-Undang. Penelitian ini bertujuan untuk mengetahui pengaturan pekerja alih daya setelah terbitnya Undang-Undang Cipta Kerja Tahun 2023 dan apakah peraturan tersebut mampu melindungi dan memenuhi hak pekerja alih daya dari eksploitasi pengusaha yang terus terjadi di Indonesia sekarang ini. Penelitian ini menggunakan jenis penelitian kualitatif dengan metode penelitian hukum normatif. Sumber data yang digunakan yakni data primer berupa Undang- Undang dan Peraturan Pemerintah Republik Indonesia yang berlaku saat ini, dan data sekunder yang terdiri dari buku, jurnal dan website. Hasil penelitian ini dapat disimpulkan bahwa dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, beberapa ketentuan telah diubah oleh Undang-Undang Nomor 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja Menjadi Undang-Undang, termasuk ketentuan yang berkaitan dengan tenaga kerja outsourcing. Berdasarkan perbandingan yang lama antara Undang-Undang Ketenagakerjaan dan Undang-Undang Cipta Kerja, perlu diingat bahwa Undang- Undang Cipta Kerja juga menimbulkan kontroversi, terutama terkait dengan perlindungan tenaga kerja. Beberapa ketentuan, seperti yang berkaitan dengan jenis pekerjaan, waktu kerja, dan pesangon, dianggap dapat mengurangi perlindungan bagi tenaga kerja yang dioutsourcing. Selain itu Undang-Undang Cipta Kerja No. 6 Tahun 2023 mengatur perlindungan pekerja dari jaminan sosial, hari dan jam kerja, waktu dan hari libur, upah dan tunjangan, dan ketentuan pemutusan hubungan kerja. Namun, jika terjadi ketidaksesuaian yang dialami oleh pekerja alih daya, mereka dapat mengambil tindakan hukum non-litigasi seperti bipartit, mediasi, konsiliasi, atau arbitrase. Kata Kunci: Pekerja, Alih Daya, Outsourcing, Undang-Undang Nomor 6 tahun 2023 tentang Cipta Kerja. / This research discusses the juridical analysis of outsourced workers in terms of Law No. 6 of 2023 on Job Creation Stipulating Government Regulation in Lieu of Law No. 2 of 2022 on Job Creation into Law. This study aims to determine the regulation of outsourced workers after the issuance of the Job Creation Law and whether the regulation is able to protect and fulfill the rights of outsourced workers from the exploitation of employers that continues to occur in Indonesia today. This research uses qualitative research with normative legal research methods. The data sources used are primary data in the form of laws and government regulations of the Republic of Indonesia that are currently in force, and secondary data consisting of books, journals and websites. The result of this research can be concluded that in Law Number 13 of 2003 on Manpower, several provisions have been amended by Law Number 6 of 2023 on the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 on Job Creation into Law, including provisions relating to outsourced labor. Based on the old comparison between the Manpower Law and the Job Creation Law, it should be noted that the Job Creation Law has also caused controversy, especially in relation to labor protection. Some provisions, such as those relating to the type of work, working time, and severance pay, are considered to reduce protection for outsourced labor. In addition, the Job Creation Law No. 6 of 2023 regulates the protection of workers from social security, working days and hours, time and holidays, wages and benefits, and provisions for termination of employment. However, in the event of discrepancies experienced by outsourced workers, they can take non-litigation legal action such as bipartite, mediation, conciliation, or arbitration.
