Abstract

Abstrak Judul : Perlindungan Hukum Broker Properti Dalam Perspektif Undang – Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen Peranan properti terhadap perekonomian Indonesia memberikan kontribusi terhadap produk domestik bruto, bahkan tenaga kerja yang terlibat dalam perputaran ekonomi di sektor properti ini menyentuh 13 juta sampai dengan 19 juta. Oleh karena itu standarisasi broker sangat penting sebagai bagian dari upaya perlindungan hukum dalam industri properti, dan salah satu rantai pasok yang penting dalam perlindungan konsumen dan peran broker properti adalah ketika memasarkan suatu produk properti bagi pengembang, dengan adanya sertifikasi broker properti adalah bentuk dari pelaksanaan Undang – Undang Perlindungan Konsumen. Rumusan masalah penelitian ini adalah: (1). Apakah penting sertifikasi broker properti dalam perspektif Undang – Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen, dan (2). Bagaimana bentuk perlindungan hukum bagi sertifikasi broker properti. Metode penelitian yang digunakan hukum normatif (doctrinal) yaitu merupakan penelitian yang mengkaji studi dokumen menggunakan berbagai data sekunder seperti Peraturan Perundang – Undangan, putusan pengadilan, teori hukum, dan pendapat para sarjana. Penelitian ini menghasilkan kesimpulan yaitu, Sertifikasi broker properti dalam perlindungan konsumen merupakan perlindungan atas hak – hak konsumen dari pelaku usaha maupun pemerintah berdasarkan perjanjian, maupun Peraturan Perundang – Undangan yang berlaku, dan Bentuk perlindung hukum sertifikasi broker properti, jika merasa dirugikan dapat mengajukan gugatan ke pengadilan negeri, dan jika terjadi perbuatan melawan hukum, maka broker properti dapat mengajukan gugatan sebagaimana yang diatur dalam Pasal 1236 dan Pasal 1243 KUHPerdata. Kata Kunci: Perlindungan Hukum, Sertifikasi broker properti, Undang – Undang Perlindungan Konsumen. / Abstract Title: Legal Protection of Property Brokers in Perspective Law Number 8 of 1999 concerning Consumer Protection The role of property in the Indonesian economy contributes to gross domestic product, even the workforce involved in the economic cycle in the property sector reaches 13 million to 19 million. Therefore, broker standardization is very important as part of legal protection efforts in the property industry, and one of the important supply chains in consumer protection and the role of property brokers is when marketing a property product for developers, with property broker certification being a form of implementing the Law. -law – Consumer Protection Act. Formulation of the problem his research are: (1). Is property broker certification important from the perspective of Law Number 8 of 1999 concerning Consumer Protection, and (2). What is the form of legal protection for property broker certification? The research method used by normative law (doctrinal) is research that examines document studies using various secondary data such as laws and regulations, court decisions, legal theory and the opinions of scholars. This research produces the conclusion, namely, Property broker certification in consumer protection is a protection for consumer rights from business actors and the government based on agreements, as well as applicable laws and regulations, and a form of legal protection for property broker certification, if you feel you have been disadvantaged you can file a lawsuit against district court, and if an unlawful act occurs, the property broker can file a lawsuit as regulated in Article 1236 and Article 1243 of the Civil Code.
