Abstract
Konflik antara pengusaha dan karyawan merupakan hal yang umum. Pemutusan hubungan kerja tanpa memberikan hak hukum kepada pekerja merupakan masalah penting dalam penyelesaian sengketa pemutusan hubungan kerja. Pada skripsi ini membahas masalah tersebut dari pengaturan peralihan perubahan status pekerja dari Pekerja Harian Lepas hingga ke Perjanjian Kerja Waktu Tertentu, dan bagaimana penerapan hukum atas peralihan Pemutusan Hubungan Kerja dalam perkara Nomor : 115/Pdt.sus-PHI/2023/PN.Jkt.Pst. Penelitian ini menggunakan metode penelitian hukum normatif berbasis kasus dan undang-undang. Dokumen hukum primer, seperti putusan pengadilan dan peraturan perundang-undangan, dan bahan hukum sekunder, seperti publikasi terkait ketenagakerjaan, karya tulis, dan buku, merupakan dua kategori dan sumber data yang digunakan. Hasil kajian menunjukkan bahwa dengan mengabaikan ketentuan UU Ketenagakerjaan, PT. Batara Tabaraka menerapkan sistem kerja yang semula merupakan perjanjian kerja harian lepas, berakhir menjadi PKWT. Putusan Pengadilan Hubungan Industrial Nomor: 115/Pdt.Sus-PHI/2023/PN Jkt.Pst dalam pertimbangan Majelis Hakim kurang jeli atau kurang tepat karena Majelis Hakim hanya melihat dan memeriksa bukti-bukti yang ada dan tidak benar-benar menelusuri adanya surat pengunduran diri padahal PKWT diselesaikan sampai akhir masa kontrak kerjanya, sehingga pekerja tidak mendapatkan hak-hak semestinya dan belum sepenuhnya memenuhi asas perlindungan hukum bagi pekerja karena belum mencerminkan rasa keadilan dan tidak berpihak kepada pekerja. Kata Kunci : Perlindungan Hukum, Perjanjian Kerja Waktu Tertentu, Pemutusan Hubungan Kerja. / Conflicts between employers and employees are common. Termination of employment without providing legal rights to workers is an important issue in resolving termination disputes. This thesis discusses this issue from the regulation of the transition of worker status changes from Casual Daily Workers to Fixed-Term Employment Agreements, and how the law is applied to the transition of Termination of Employment in case Number: 115/Pdt.sus-PHI/2023/PN.Jkt.Pst. This study uses normative legal research methods based on cases and laws. Primary legal documents, such as court decisions and laws and regulations, and secondary legal materials, such as publications related to employment, written works, and books, are two categories and sources of data used. The results of the study show that by ignoring the provisions of the Manpower Law, PT. Batara Tabaraka implemented a work system that was originally a casual daily work agreement, ending up as a PKWT. The Industrial Relations Court Decision Number: 115/Pdt.Sus-PHI/2023/PN Jkt.Pst in the consideration of the Panel of Judges was not thorough or not quite right because the Panel of Judges only looked at and examined the existing evidence and did not really trace the existence of a letter of resignation even though the PKWT was completed until the end of the work contract period, so that workers do not get their proper rights and have not fully fulfilled the principle of legal protection for workers because they do not reflect a sense of justice and do not side with workers.
