Abstract

Eksistensi internet banking, disamping menjanjikan sejumlah harapan, pada saat yang sama juga melahirkan kecemasan-kecemasan yang baru, seperti menjadi target dalam kejahatan di dunia maya (cyber crime). Cyber crime dapat dilakukan tanpa mengenal batas teritorial dan tidak memerlukan interaksi langsung antara pelaku dan korban kejahatan. Melihat dari macam-macam ancaman cyber crime maka sudah seharusnya bank sebagai pihak penyelenggara menjaga kerahasiaan informasi nasabahanya. Berdasarkan hal tersebut metode yang dipakai adalah metode pendekatan yuridis normative yaitu, dilakukan dengan cara mengkaji, menelaah dan mempelajari bahan-bahan kepustakaan yang berupa bahan hukum primer, sekunder, maupun tersier untuk menjawab permasalahan yang menjadi fokus penelitian Perlindungan dan keamanan terhadap data pribadi nasabah merupakan suatu unsur pokok terpenting dalam dunia perbankan yang berlandaskan kepercayaan nasabah. Ditambah belum adanya regulasi khusus yang mengatur mengenai perlindungan data pribadi ini semakin mempertanyakan seberapa pentingkah perlindungan data pribadi bagi suatu individu dan seberapa efektifkah peraturan-peraturan yang ada saat ini untuk melindungi masyarakat dari cyber crime yang semakin berinovatif dan bevariatif. / The existence of internet banking while promising many hopes, at the same time also create new solicitudes, such as being targeted in cybercrime. Cybercrime can be done without recognizing territorial boundaries and doesn’t require direct interaction between perpetrators and the victims of crime. Seeing from the various threats of cybercrime, the bank as the financial service provider should maintain the confidentiality of customer information. Based on that, the research used a normative juridicial approach method, carried out by learning, analyzing, and delving literature materials in the of primary, secondary, or tertiary legal materials to answer the problems that are the focuse of the research. The protection and security of customer’s personal information is an important principal element in the banking world based on customer trust. Plus the absence of specific regulations governing the protection of personal information is increasingly questioning about how important is the protection of personal information for an individual and how effective the existing regulations to protect the personal information from cybercrime which is increasingly innovative and varies
