Abstract

Produk merupakan barang atau jasa yang dapat diperjualbelikan. Menurut Undang-undang No 8 tahun 1999 yang dimaksud dengan barang adalah setiap benda baik berwujud maupun tidak berwujud, baik bergerak maupun tidak bergerak, dapat dihabiskan maupun tidak dapat dihabiskan, yang dapat untuk diperdagangkan, dipakai, dipergunakan, atau dimanfaatkan oleh konsumen. Dan yang dimaksud dengan Impor Barang adalah kegiatan memasukkan barang ke dalam daerah pabean. Dalam pengimporan barang syarat bea dan cukai harus terpenuhi, namun yang terjadi banyak barang yang masuk secara legal walaupun merupakan produk bermerek palsu yang dapat merugikan ataupun mengelabui konsumen. Penelitian ini menggunakan metode yuridis normatif dengan menganalisa ketentuan hukum tentang Undang-undang Perlindungan Konsumen No 8 tahun 1999, Undang-undang Merek dan Indikasi Geografis No 20 Tahun 2016, serta ketentuan dalam Kitab Undang-undang Hukum Pidana. Adapun kesimpulan daripada penelitian ini yakni masyarakat dalam hal ini konsumen dapat mengupayakan penuntutan yang telah tertera di beberapa pasal dalam Undang-undang Perlindungan Konsumen jika terbukti pelaku usaha melakukan pelanggaran, dan konsumen pun telah terlindungi dengan adanya ketentuan pada Undang-undang Merek dan Indikasi Geografis dimana Undang-undang tersebut mengatur pelaku usaha dalam menjual produknya. / Products are goods or service that can be traded. According to Law No. 8 1999 what is meant by goods is every object, both tangible and intangible, both movable and immovable, can be spent or cannot be spent, which can traded, worn, be used, or utilized by consumers. And what is meant by Imported Goods is the activity of entering goods into customs areas. In importing goods, customs and excise requirements must be met, but what happens is that many goods enter legally even though they are fake products that can harm or fool consumers. This study uses a normative juridical method by analyzing the legal provisions regarding the Consumer Protection Act No. 8 of 1999, the Trademark and Geographical Indications Law No. 20 of 2016, as well as the provisions in the Criminal Law Code. The conclusion of this research is that the public in this case the consumer x can seek prosecution that has been listed in several articles in the Protection Act if it is proven that the business actor has committed a violation, and the consumer has been protected by the provisions in the Trademark Law and Indications. The law regulates business actors in selling their products.
