Abstract

Hak tanggungan adalah hak jaminan yang dibebankan pada hak atas tanah sebagaimana dimaksud dalam Undang-Undang No.5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria. Perkembangan ekonomi dan perdagangan yang diikuti oleh perkembangan kebutuhan akan kredit dan pemberian fasilitas kredit memerlukan jaminan demi keamanan pemberian kredit. Bank dalam memberikan kredit bagi kepada debitur harus memperhatikan prinsip kehati-hatian agar tidak terjadi masalah yang akan merugikan pihak kreditur tersebut. Dalam penelitian ini terdapat dua rumusan masalah yang akan dibahas yaitu bagaimana kedudukan pemegang hak tanggungan atas tanah milik pihak ketiga dalam perjanjian kredit dan bagaimanakah bentuk perlindungan hukum bagi pemegang hak tanggungan atas tanah milik pihak ketiga berdasarkan putusan Nomor 1217 K/pdt/2016. Metode yang digunakan dalam penelitian ini adalah metode yuridis normatif. Penelitian yuridis digunakan untuk menganalisis berbagai peraturan perundangundangan yang memuat ketentuan mengenai hal-hal yang berhubungan dengan perlindungan hukum bagi pemegang hak tanggungan dalam perjanjian kredit. Dalam penelitian ini data diperoleh dengan cara kepustakaan dan sumber data yang digunakan adalah data sekunder. Dalam Undang-Undang Nomor 4 tahun 1996 tentang Hak Tanggungan memberikan kedudukan yang lebih diutamakan pada kreditur pemegang hak tanggungan serta memberikan perlindungan hukum bagi kreditur pemegang hak tanggungan. / Dependents are collateral rights which are imposed on land rights as referred to in Law Number 5 of 1960 concerning Basic Agrarian Regulations. Economic and trade developments followed by developments in the need for credit and the provision of credit facilities require guarantees for the security of credit. Banks in providing credit to debtors must pay attention to the principle of prudence so that problems do not occur that will harm the creditor. In this study there are two formulations of the problem to be discussed namely how the position of the holders of mortgage rights on land owned by third parties in the credit agreement and how the form of legal protection for holders of mortgage rights on land owned by third parties based on decision Number 1217 K / pdt / 2016. The method used in this research is normative juridical method. Juridical research is used to analyze various laws and regulations that contain p rovisions regarding matters relating to legal protection for holders of mortgage rights in credit agreements. In this study the data obtained by means of literature and data sources used are secondary data. In Law Number 4 of 1996 concerning Mortgage Rights gives a more priority position to the creditor holders of the mortgage rights and provides legal protection for the creditor holders of the mortgage rights.
