Abstract

Sebagai Warga Negara Indonesia atau Warga Negara Asing, berhak memperoleh sesuatu hak atas tanah. Di dalam ketentuan Pasal 37 ayat (1) Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah, menyebutkan setiap peralihan hak atas tanah melalui jual-beli hanya dapat didaftarkan jika dapat dibuktikan dengan akta yang dibuat Pejabat Pembuat Akta Tanah (PPAT). Dan Ketentuan dalam Pasal 19 ayat (1) UUPA tersebut merupakan ketentuan yang ditujukan kepada pemerintah untuk menyelenggarakan pendaftaran tanah di seluruh Indonesia. Rumusan masalah dalam skripsi ini adalah bagaimana peralihan Hak Milik atas tanah ditinjau dari peraturan Perundang-undangan di bidang pertanahan dan bagaimana analisis hukum terhadap putusan majelis hakim dalam perkara Nomor 842/Pdt.G/2018/PN.Tng. Penelitian ini merupakan penelitian kepustakaan (library research). Untuk memperoleh data-data, kemudia dipaparkan dalam penelitian ini, penulis menggunakan data primer, data sekunder, dan data tersier. Data primer dalam penelitian ini adalah Undang-Undang Nomor 5 tahun 1960 tentang pertanahan dan Kitab Undang-Undang Hukum Perdata, sedangkan data sekunder diperoleh dari buku-buku maupun literatur lain, data tersier diperoleh menggunakan internet, setelah data-data tersebut terkumpul lalu disusun, dijelaskan kemudian dianalisis. Hasil penelitian menunjukkan bahwa pentingnya surat dalam pertanahan di masyarakat di dukung oleh beberapa pihak seperti prosesnya mudah sederhana di dukung oleh pejabat yang berwenang seperti P.P.A.T yang di khususkan dalam mengerjakan berbagai urusan peratanahan, dan dalam pertanahan sudah di lindungi oleh paying hukum yang kuat sehingga tidak dapat di ganggu gugat jika memiliki surat-surat yang sah atau (otentik). / As an Indonesian Citizen or Foreign Citizen, has the right to obtain a right to land. In the provisions of Article 37 paragraph (1) of Government Regulation Number 24 of 1997 concerning Land Registration, it is stated that every transfer of land rights through a sale can only be registered if it can be proven by a deed made by the Land Deed Making Officer (PPAT). And the provisions in Article 19 paragraph (1) of the LoGA are provisions intended for the government to carry out land registration throughout Indonesia. The formulation of the problem in this thesis is how the transfer of ownership rights over land in terms of legislation in the field of land and how the legal analysis of the judges' decision in case Number 842 / Pdt.G / 2018 / PN.Tng. This research is a library research (library research). To obtain data, then explained in this study, the authors use primary data, secondary data, and tertiary data. Primary data in this study are Law No. 5 of 1960 concerning land and the Civil Code, while secondary data are obtained from books and other literature, tertiary data is obtained using the internet, after these data are collected and compiled, explained later analyzed. The results showed that the importance of letters in land affairs in the community was supported by several parties such as the simple process was supported by authorized officials such as PPAT which was specialized in working on various matters of land affairs, and in land matters were protected by paying strong laws so that they could not be sued if you have legal or authentic documents
