Abstract

Eksaminasi menurut undang-undang nomor 1 tahun 1978 tentang eksaminasi adalah suatu bentuk pengujian atau penilaian dari sebuah outusan hakim apakah pertimbangan-pertimbangan hukumnya telah sesuai dengan prinsip-prinsip hukum dan apakah prosedur hukum acaranya telah sesuai dengan yang diterapkan dengan benar, serta apakah putusan tersebut telah menyentuh rasa keadilan masyarakat. Dalam penelitian tersebut menggunakan analisis normatif, untuk membahas tentang eksaminasi pada pandangan hakim dengan menganalisa pertimbangan hakim terhadap putusan hakim yang sudah inkrah. Berdasarkan hasil penelitian ini maka dapat disimpulkan dalam memutus perkara nomor 112/pis.sus/tpk/2016/pn.jkt.pst adalah bahwa majelis hakim kurang tepat dalam cara memilih dan menentukan alternatif dakwaan yang dibuktikan Karena kurang memberikan pertimbagan yang rasional dalam memilih dakwaan alternatif yang diajukan Penuntut Umum, disini terlihat rancu dengan pembuktian dakwaaan subsidaritas yang memang harus dibuktikan dakwaan primer terlebih dahulu, baru bila tidak terbukti akan dibuktikan dakwaan yang subsidair, bila tidak terbukti maka akan dibuktikan dengan dakwaan yang lebih subsidair lagi. / Examination according to law number 1 of 1978 concerning examination is a form of testing or evaluation of a judge's decision whether the legal considerations are in accordance with legal principles and whether the procedural law is in accordance with the one applied correctly, and whether the decision is has touched the sense of community justice. In the study using normative analysis, to discuss the examination of the views of judges by analyzing the judges' consideration of the decisions of judges who have been inclined. Based on the results of this study, it can be concluded that in deciding case number 112 / pis.sus / tpk / 2016 / pn.jkt.pst is that the panel of judges is not right in how to choose and determine the proven alternative charges because it does not provide a rational consideration in choosing the charges the alternative proposed by the Public Prosecutor, here it seems ambiguous by proving the charges of subsidaritas that the primary indictment must be proven first, and if it is not proven to be a subsidiary indictment, if it is not proven it will be proven by the more subsidized charges.
