Abstract

Perjudian awalnya hanya berlangsung secara konvensional contohnya dengan cara tatap muka, namun seiring dengan berkembangya teknologi khusus nya internet. Perjudian kemudian berkembang melalui media internet, namun dalam penerapan pembuktian perjudian online ini kurang efektif dalam studi kasus putusan No. 1672/PID.B/2010/PN.JKT.PST). Berdasarkan uraian tersebut di atas, yang melatar belakangi permasalahan bagaimanakah hukum pembuktian terhadap tindak pidana perjudian online dalam hukum acara pidana dan penerapan hukum pembuktian dalam studi kasus tersebut. Jenis dan penelitian yang di gunakan dalam penelitian ini adalah yuridis normatif. Dalam penelitian normatif yang di teliti adalah daftar pustaka atau data sekunder, yang mencakup bahan hukum primer, sekunder, dan tresier. Penelitan ini menggunakan metode kepustakaan yaitu metode yang berdasarkan atas studi literatur buku-buku yang bersifat ilmiah peraturan perundang-undangan terkait surat kabar, serta matakuliah yang berhubungan dengan penyelesaian permasalahan tersebut Hasil penelitian menyatakan bahwa proses pembuktian perjudian online dilakukan berdasarkan KUHAP yaitu dilakukan dengan tahap pembuktian di persidangan dengan acara pemeriksaan biasa dengan menggunakan alat-alat bukti yang sah menurut KUHAP tetapi tidak dilampirkan alat bukti yang diatur dalam Undang-Undang ITE. / Gambling initially only took place conventionally for example by face to face, but along with the development of special technology the internet. Based on the description above, the background of the problem is how the law of proof of online gambling in criminal procedure law and the application of evidentiary law in the case study. The type and research used in this study are normative juridical. In normative research that is examined is a bibliography or secondary data, which includes primary, secondary, and transient legal materials. This research uses the biblical method, which is a method based on the study of literature on scientific books on legislation related to newspapers, as well as subjects related to solving these problems. The results of the study state that the process of proving online gambling is carried out based on the KUHAP, which is carried out at the stage of proof at the trial with regular inspection events using legal evidence according to the Criminal Procedure Code but not attached to the evidence stipulated in the ITE Law.
