Abstract

Perkembangan industry di bidang teknologi dan industry kreatif sangat pesat beberapa tahun terakhir menghasilkan inovasi-inovasi yang dapat menggeser dan mengganti sistem tradisional yang terdapat pada industry. Salah satu dari inovasi tersebut ialah Crowdfunding yaitu sebuah Platfrom mengenai Pengumpulan dana donasi dari public. Didalam negeri Pengumpulan atau Penggalangan dana sudah sangat dikenal sejak lama yang merupakan prinsip dari gotong royong, namun kini praktek dari pengumpulan dana kian berkembang dan lebih terjangkau dengan adanya kehadiran Donation Based Crowdfunding, sebuah platform yang mempertemukan pihak yang membutuhkan dana dengan pihak yang ingin memberi dananya. Pesatnya perkembangan ini sehingga menimbulkan masalah-masalah dalam perlaksanaannya. Hingga kini platform donation crowdfunding belum memiliki aturan hukum yang jelas dan mengatur secara spesifik. Untuk dapat menganalisis permasalahan ini maka diperlukannya pendekatan yuridis normative yang mengkaji berdasarkan Undang-Undang Nomor 9 Tahun 1961 dan PP No.29 Tahun 1980 agar terdapatnya suatu kepastian hukum. Peraturan undang-undangan ini pada dasarnya sudah telah terlebih mengatur kegiatan penggalangan dana. Namun, aturan ini belum dapat mengakomodir secara keseluruha pelaksanaan kegiatan tersebut. Pemerintah seharus menyesuaikan peraturan yang tepat untuk dapat mengakomodir perkembangan tersebut serta membuat suatu kepastian hukum dari kegiatan penggalangan dana. Penilitian ini dibuat dan telah menghasilkan penemuan bahwa peraturan-peraturan perundang-undangan yang telah ada belum cukup untuk dapat mengakomodir Donation Based Crowdfunding, sehingga diperlukan pertauran perundang-undangan yang khusus mengatur mengenai hal ini. Kata Kunci : Kepastian Hukum, Pengumpulan Dana, Crowdfunding. / The development of industry in the technology and creative industries has been very rapid in recent years producing innovations that can shift and replace traditional systems found in the industry. One of these innovations is Crowdfunding, a platform for collecting donations from the public. In the country of fundraising or fundraising has been very well known for a long time which is the principle of mutual cooperation, but now the practice of fundraising is growing and more affordable with the presence of Donation Based Crowdfunding, a platform that brings together those who need funds with those who want to provide funds . The rapid development of this has led to problems in its implementation. Until now the crowdfunding donation platform does not yet have clear and specific legal rules. To be able to analyze this problem, it requires a normative juridical approach that studies based on Law Number 9 of 1961 and PP No.29 of 1980 so that there is a legal certainty. These laws and regulations have basically governed fundraising activities. However, this regulation has not been able to accommodate the overall implementation of these activities. The government should adjust the appropriate regulations to accommodate these developments and make legal certainty from fundraising activities. This research was made and has resulted in the discovery that the existing legislation is not enough to be able to accommodate Donation Based Crowdfunding, so it is necessary to have specific legislative regulations governing this matter.
