Abstract

Indonesia dan Malaysia memiliki perjanjian kerjasama yaitu Perjanjian Bilateral dalam pengiriman atau penempatan tenaga kerja di Malaysia. Indonesia dan Malaysia membuat perjanjian dengan bentuk Memorandum of Understanding (MoU) tentang Penempatan dan Pelindungan bagi Pekerja Migran Indonesia Sektor Domestik di Malaysia, dan Pemerintah Malaysia membuat kebijakan atau program baru yaitu Rekalibrasi Tenaga Kerja. Rekalibrasi merupakan program pemutihan bagi Pekerja Migran ilegal yang berada di Malaysia. Terdapat 2 (dua) jenis rekalibrasi yaitu rekalibrasi pemulangan dan rekalibrasi tenaga kerja (tetap bekerja). Di dalam MoU tidak ada pengaturannya untuk Pekerja Migran Indonesia yang ilegal, bahkan regulasi nasional tidak ada pengaturannya yang khusus bagi Pekerja Migran Indonesia yang ilegal. Adanya kebijakan atau program rekalibrasi ini memberikan keuntungan, keadilan, dan upaya perlindungan hukum dari Malaysia terhadap seluruh Pekerja Asing Tanpa Izin (PATI) yang bermigrasi dan melalukan pekerjaan di Malaysia secara ilegal untuk menjadi legal dan memiliki perlindungan hukum untuk dirinya. Kata Kunci: Pekerja Migran Indonesia, Memorandum of Understanding, Rekalibrasi. / Indonesia and Malaysia have a cooperation agreement known as the Bilateral Agreement on the deployment or placement of Labour in Malaysia. Indonesia and Malaysia entered into an agreement in the form of a Memorandum of Understanding (MoU) on Placement and Protection for Indonesian Migran Workers in the Domestic Sector in Malaysia. The Malaysian Government also introduced a newa policy or program called Labour Recalibration. Recalibration is a whitening program for illegal Migrant Workers in Malaysia. There are 2 (two) types of recalibration: repatriation recalibration and recalibration for workers (to continue working). The MoU does not have provisions for illegal Indonesian Migrant Workers, and even national regulations do not specifically address the situation of illegal Indonesia Migran Workers. The implementation of this recalibration policy provides benefits, fairness, and legal protection efforts from Malaysia for all Undcumented Foreign Workers who migrate and work illegally in Malaysia, allowing the to become legal and have legal protection.
