Abstract

Tindakan penganiayaan binatang ini telah tertulis didalam KUHP sebagai perbuatan yang diancamkan hukuman paling lama sembilan bulan. Tindakan untuk menganiaya seekor binatang ini memanglah suatu tindakan yang tidak terpuji dan meresahkan masyarakat. Terdapat rumusan masalah yang ada didalam skripsi ini, yakni bagaimana kualifikasi pelaku tindak pidana penganiayaan hewan menurut hukum dan bagaimana penerapan hukum pidana materiil terhadap pelaku tindak pidana penganiayaan hewan. Penelitian ini memakai pendekatan kasus, bahan hukum primer yang dipakai berasal dari perundang - undangan, bahan hukum sekunder yang dipakai bersumber dari buku, jurnal hukum, dan skripsi, bahan hukum tersier berupa ensiklopedia, serta kamus hukum. Kemudian, teknik pengumpulan data ini didapatkan melalui perundang - undangan, buku, skripsi, jurnal, internet, dan hasil penelitian yang berhubungan dengan permasalahan yang akan diteliti. Dalam hal ini, seseorang yang bertindak menganiaya seekor binatang ini bisa terjadi karena hanya ingin memuaskan keinginannya saja tanpa tujuan dan bisa juga karena memiliki suatu tujuan, tetapi ia harus menyakiti binatang tersebut agar tujuannya bisa tercapai. Kepada seseorang yang telah terbukti bertindak menganiaya seekor binatang ini akan dikenakan sebuah sanksi pidana yang ada pada pasal 302, 540, dan 541 KUHP, serta pasal 91B UU No. 41 tahun 2014 tentang Peternakan dan Kesehatan Hewan. Kata Kunci : Tindak Pidana, Penganiayaan, Hewan. / The act of persecution of this animal has been recorded in the Code of Criminal Procedure as an act threatened with a maximum sentence of nine months. The act of persecuting this animal is indeed an act of disgrace and distress to the public. There is a series of issues in this script, namely how the perpetrators of animal persecution are qualified by law and how material criminal law is applied to perpetrates of animal prosecution. This research uses a case approach, the primary legal material used comes from legislative invitations, secondary legal materials used from sources from books, legal journals, and scripts, tertiary law materials in the form of an encyclopaedia, as well as legal dictionaries. Later, this data collection technique is obtained through legislative invites, books, scriptions, magazines, the internet, and research results related to the issues to be studied. In this case, a person who acts as an insult to this animal can be done only because he wants to satisfy his desire without a purpose and can also because he has a purpose, but he must hurt the animal in order to its purpose. Anyone who has been shown to have acted in harassment of this animal will be subject to a criminal sanction contained in sections 302, 540, and 541 of the Code of Criminal Law, as well as section 91B of Act No. 41 of 2014 on Livestock and Animal Health.
