Abstract

Masih marak terjadinya Pemutusan Hubungan Kerja secara sepihakyangterjadi di Indonesia merupakan salah satu contoh bahwa pemutusan hubungankerja belum dilakukan sesuai dengan apa yang seharusnya. Bahwa apabilaterjadi pemutusan hubungan kerja secara sepihak, bagaimana perlindunganhukum bagi pekerja/buruh? Dan apakah PUTUSAN NOMOR11/Pdt.Sus- PHI/2019/PN.Ptk yang penulis gunakan sebagai objek dari penelitianini sudah sesuai dengan Undang-Undang Nomor 2 Tahun 2004 TentangPenyelesaian Perselisihan HubunganIndustrial? Yuridis Normatif merupakan metode yang digunakan oleh penulis dalampenilitian ini, sehingga pendekatan perundang-undangan adalah cara yangdipilih oleh penulis dalam penelitian ini, yang dimulai dari Pasal 28 Dayat (2) Undang-Undang Dasar 1945, Undang-Undang No.13 Tahun 2003, sertaUndang-Undang No. 2 Tahun 2004. Pada akhirnya penulis mengambil kesimpulan yaitu Perlindungan secarahukum terhadap pekerja/buruh terkait Pemutusan Hubungan Kerja secaraumum terdapat pada pasal 153 ayat (1) dan (2) Undang-Undang Nomor 13Tahun 2003 dan PUTUSAN NOMOR 11/Pdt.Sus-PHI/2019/PN.Ptk, penulismeneliti mengenai Pemutusan Hubungan Kerja agar pemutusan hubungankerja secara sepihak pada PUTUSAN NOMOR 11/PDT.SUS- PHI/2019/PN.PTK harus memuat dan sesuai dengan pasal 97, pasal 100, danpasal 102 ayat (1) Undang-Undang No.2 Tahun 2004. / There is still a rise in unilateral termination of employment that occurs inIndonesia is one example that the termination of employment has not beendone in accordance with what should be done. That if there is a unilateral termination of employment, what is the legal protection for workers / workers? And is the DECISION NO. 11/Pdt.Sus-PHI/2019/PN.Ptk that theauthor used as the object of this study in accordance with LawNo. 2 of 2004on The Resolution of Industrial Relations Disputes? Normative Juridical is the method used by the author in this study, sothelegal approach is the way chosen by the author in this study, which startsfrom Article 28 D paragraph (2) of the 1945 Constitution, LawNo.13of 2003, and Law No. 2 of 2004. In the end, the author concluded that legal protection of workers / workers related to termination of employment in general is containedinarticle 153 paragraph (1) and (2) of Law No. 13 of 2003 and Decree NO. 11/ Pdt.Sus-PHI / 2019 / PN.Ptk, the author examined the Termination of Employment in order to unilaterally terminate employment in DECISIONNO. 11 / PDT. SUS- PHI/2019/PN. Ptk must contain and in accordance witharticle 97, article 100, and article 102 paragraph (1) of Law No.2 of 2004
