Abstract

Jaminan Fidusia merupakan salah satu kegiatan usaha pada perusahaan pembiayaan, jaminan fidusia ini disebut juga sebagai penyerahan hak milik secara kepercayaan dari debitur kepada kreditur. Kegiatan Jaminan Fidusia diatur di dalam UU No 42 Tahun 1999 Tentang Jaminan Fidusia, salah satu nya mengenai mekanisme eksekusi objek jaminan fidusia, di dalam UU No 42 Tahun 1999 Tentang Jaminan Fidusia eksekusi objek jaminan fidusia dilakukan dengan cara: secara sifat eksekusi (dengan memakai title eksekutorial), secara parate eksekusi yaitu dengan menjual tanpa perlu penetapan dari pengadilan, dan dijual dibawah tangan oleh kreditur sendiri. Metode penelitian ini menggunakan pendekatan yang bersifat yuridis normatif. Teknik pengumpulan data yang digunakan adalah studi kepustakaan, yaitu penelitian terhadap data sekunder yaitu mengacu kepada norma hukum yang terdapat pada peraturan perundang-undangan dan putusan pengadilan. Tindakan yang dilakukan oleh PT.MayBank Indonesia Finance terhadap objek jaminan pembiayaan yang dimiliki oleh Dhani Sukarni merupakan Perbuatan Melawan Hukum. Pertimbangan hukum majelis hakim Pengadilan Negeri Sumber sangat tidak relevan jika dikaitkan dengan Putusan Mahkamah Konstitusi Nomor 18/PUU-XVII/2019. / Fiduciary guarantee is one of the business activities of finance companies, this fiduciary guarantee is also referred to as the transfer of property rights in trust from the debtor to the creditor.
