Abstract

Bisnis jasa titip (personal shopper) merupakan suatu usaha jenis baru di industri perdagangan yang menawarkan barang atau jasa melalui media sosial dengan menggunakan jejaring internet. Dalam menjalankan bisnisnya, mekanisme profesi jasa titip yatiu seorang jasa titip berperan sebagai pihak ketiga yang menghubungkan konsumen dengan penjual utama. Usaha jasa titip online ini produk yang digemari konsumen biasanya berupa produk fashion, kosmetik, dan aksesoris. Namun, transaksi secara elektronik ini rentan akan cacat barang karena tidak bertemu langsung secara tatap muka. Rumusan masalah dalam skripsi ini adalah meneliti aspek hukum jasa titip online dari peraturan perundang-undangan dan perlindungan hukum atas cacat barang terhadap konsumen. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan Undang-undang dan pendekatan konseptual. Data yang digunakan dalam penelitian ini adalah data sekunder yang mencakup bahan hukum primer: Kitab Undang-Undang Hukum Perdata, Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Teknologi Elektronik, Peraturan Pemerintah Nomor 71 Tahun 2019 tentang Penyelenggaraan Sistem dan Transaksi, sedangkan bahan hukum sekunder diperoleh dari buku-buku, artikel, jurnal, hasil penelitian sebelumnya, dan bahan hukum tersier yang berupa kamus dan penelusuran internet, kemudian bahan hukum tersebut disusun dan dianalisis. Dari penelitian ini dapat disimpulkan bahwa jasa titip online ini dalam melakukan suatu transaksi didasari perjanjian sesuai dengan Pasal 1320 KUHPerdata syarat sahnya perjanjian, begitupun juga dengan transaksi secara online yang berlandaskan UU ITE. Namun, tetap berlandasakan pada suatu syarat sahnya perjanjian. Apabila transaksi jasa titip secara online terjadi cacat barang, maka peraturan perundang-undangan di Indonesia, mulai dari Kitab Undang-Undang Hukum Perdata, Undang-undang Perlindungan Konsumen, dan Undang-Undang Informasi dan Transaksi Elektronik memberikan perlindungan terhadap konsumen dan pelaku usaha yang bertanggungjawab terhadap kerusakan dan cacat tersembunyi. Kata Kunci : Jasa Titip Online, Perlindungan Hukum, Cacat Barang, Konsumen. / The personal shopper business is a new type of business in the trade industry that offers goods or services through social media using the internet networks. In running its business, the mechanism of the trust service profession is that a trust service acts as a third party that connects consumers with the main seller. This online entrustment service business products that are favored by consumers are usually in the form of fashion products, cosmetics, and accessories. However, this electronic transactions is vulnerable to defects in goods because they do not meet face-to-face. The formulation of the problem in this thesis is to examine the legal aspects of online delivery services from laws and regulations and legal protection for defects in goods to consumers. This research is a normative legal research using statute approach and conceptual approach. The data used in this study is secondary data that include primary legal materials: Civil Code, Law Number 8 of 1999 concerning Consumer Protection, Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Technology, Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions. While secondary legal materials are obtained from books, articles, journals, previous research results, and tertiary legal materials in the form of dictionaries and internet searches, then the legal materials are compiled and analyzed. From this research it can be concluded that this online entrustment service in conducting a transaction is based on a sale and purchase agreement and authorization between the two parties in accordance with the Article 1320 of the Civil Code for the validity of an agreement, as well as online transactions based on the Electronic Information and Transaction Law. However, it is still based on a valid agreement requirement. If online entrusted service transactions occur defects in goods, then the laws and regulations in Indonesia, starting from the Civil Law, Consumer Protection Law, and Electronic Information and Transaction Law provide protection for consumers and business actors who are responsible for damage and hidden defects.
