Abstract
Di dalam hubungan kerja, seringkali terjadi perselisihan yang timbul di ranah industrial antara pekerja dan pengusaha. Terjadinya perselisihan hubungan industrial merupakan tantangan serius yang dapat mempengaruhi stabilitas dan produktivitas suatu perusahaan. Salah satu pokok permasalahan yang kerap kali muncul yaitu pemutusan hubungan kerja sepihak, dimana adanya perbedaan interpretasi dan pelaksanaan ketentuan hukum yang terkadang menjadi pemicu timbulnya ketegangan antara pekerja dengan pengusaha. Rumusan masalah dalam skripsi ini adalah bagaimana perlindungan hukum pekerja jika pengusaha melakukan pemutusan hubungan kerja, dan Apakah penerapan putusan hakim dalam putusan Mahkamah Agung Nomor 166 K/Pdt.Sus-PHI/2020 sudah sesuai dengan peraturan perundang-undangan yang berlaku. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan kasus. Data yang digunakan adalah data sekunder berupa bahan hukum primer: Undang-Undang Nomor 13 Tahun 2003, Undang-Undang Nomor 2 Tahun 2004, Putusan Mahkamah Agung Nomor 166 K/Pdt.Sus-PHI/2020, bahan hukum sekunder diperoleh dari buku-buku maupun literatur lain, bahan hukum tersier berupa kamus, kemudian bahan hukum yang terkumpul disusun dan dianalisis. Dari hasil penelitian ini dapat disimpulkan bahwa dalam melakukan pemutusan hubungan kerja maka harus berdasarkan pada ketentuan peraturan perundang-undangan yang berlaku dengan memperhatikan perlindungan hukum dan keadilan terhadap pekerja dengan cara memberikan hak-haknya agar pemutusan hubungan kerja yang dilakukan terhadap pekerja tidak bertentangan dengan aturan hukum. Kata Kunci: Pemutusan Hubungan Kerja, Perselisihan Hubungan Industrial, Pengadilan Hubungan Industrial. / In employment relations, disputes often arise in the industrial realm beetween workers and employers. The occurrence of industrial relations disputes is a serious challenge that can affect the stability and productivity of a company. One of the main problems that often arises is unilateral termination of employment relations, where there are differences in the interpretation and implementation of legal provisions which sometimes trigger tensions between workers and employers. The formulation of the problem in this thesis is how to legally protect workers if the employer terminates their employment relationship, and whether the implementation of the judge’s decision in the Supreme Court Decision Number 166K/Pdt.Sus-PHI/2020 is in accordance with the applicable laws and regulations. This research is normative legal research with a case approach. The data used is secondarydata in the form of primary legal materials: Law Number 13 of 2002, Law Number 2 of 2004, Supreme Court Decision Number 166K/Pdt.SusPHI/2020, secondary legal materials are obtained from books and other literature, tertiary legal materials are in the form of dictionaries, then the collected legal materials are compiled and analyzed. From the results of this research, it can be concluded that when terminating employment relations, it must be based on the provisions of applicable laws and regulations taking into account legal protection and justice for workers by providing their rights so that the termination of employment relations carried out against workers does not conflict with legal regulations.
