Abstract

ABSTRAK Judul Disertasi : PERLINDUNGAN HUKUM TERHADAP PEMUTUSAN HUBUNGAN KERJA DALAM RANGKA MEMPERTAHANKAN KELANGSUNGAN DUNIA USAHA DIKAITKAN DENGAN INVESTASI DI INDONESIA Pemutusan hubungan kerja adalah suatu langkah pengakhiran hubungan kerja antara buruh dan majikan karena suatu hal tertentu dan merupakan yang seharusnya dapat dihindarkan, baik itu oleh pengusaha atau pun oleh pekerja/ buruh. Namun sering terjadi dan sering ditemui adanya kasus-kasus Pemutusan Hubungan Kerja (PHK) karena akan berdampak kepada kelangsungan usaha dan investasi di Indonesia. Permasalahan dalam penelitian ini adalah 1. Apakah penerapan dan aturan tentang pemutusan hubungan kerja dapat memberikan kepastian dalam keberlangsungan dunia usaha? 2. Mengapa peranan pemerintah atas pemutusan hubungan sangat penting dalam rangka mempertahankan kelangsungan dunia usaha dikaitkan dengan investasi di Indonesia? 3. Bagaimana perlindungan hukum terhadap pengusaha atas pemutusan hubungan kerja dalam rangka mempertahankan kelangsungan dunia usaha dikaitkan dengan investasi di Indonesia? Dengan penelitian yuridis empiris diketahui bahwa 1. Penerapan pengaturan tentang pemutusan hubungan kerja memberikan kepastian dalam keberlangsungan dunia usaha masih banyaknya dijumpai perusahaan/pengusaha yang melakukan PHK terhadap pekerjanya tetapi tidak/belum melakukan pemenuhan kewajibannya sesuai dengan ketentuan Undang-Undang. 2. Peranan pemerintah atas PHK dalam rangka mempertahankan kelangsungan dunia usaha dikaitkan dengan investasi di Indonesia dengan menjamin hak-hak dasar pekerja yang merupakan merupakan esensi dari disusunnya Undang-undang Cipta Kerja yaitu mewujudkan memenuhi hak warga negara atas pekerjaan dan penghidupan yang layak bagi kemanusiaan kesejahteraan para pekerja yang akan berimbas terhadap kemajuan dunia usaha dan investasi di Indonesia. 3. Upaya perlindungan hukum terhadap pengusaha atas pemutusan hubungan kerja dalam rangka mempertahankan kelangsungan dunia usaha dikaitkan dengan investasi di Indonesia yaitu pengusaha wajib memenuhi hak-hak pekerja sesuai dengan Undang-Undang Nomor 6 Tahun 2023 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 Tentang Cipta Kerja, sehingga tidak akan terjadi keterlambatan dalam pembayaran upah/hak-hak lain yang harus diterima oleh pekerja/buruh. Kata Kunci: Perlindungan, Pemutusan Hubungan Kerja, Dunia Usaha dan Investasi. / ABSTRACT Judul Disertasi : LEGAL PROTECTION AGAINST TERMINATION OF EMPLOYEE IN THE FRAMEWORK OF MAINTAINING THE CONTINUITY OF THE BUSINESS WORLD ASSOCIATED WITH INVESTMENT IN INDONESIA Termination of employment is a step to terminate the employment relationship between workers and employers for a certain reason and is something that should have been avoided, either by the employer or by the worker/labor. However, it often happens and there are often cases of Termination of Employment (PHK) because it will have an impact on the continuity of business and investment in Indonesia. The problems in this research are 1. Can the application and rules regarding termination of employment provide certainty in the sustainability of the business world? 2. Why is the government's role in terminating relations so important in order to maintain the continuity of the business world in relation to investment in Indonesia? 3. How is the legal protection for employers against termination of employment in order to maintain the continuity of the business world related to investment in Indonesia? With empirical juridical research it is known that 1. The application of regulations regarding termination of employment provides certainty in the continuity of the business world. There are still many companies/employers who lay off workers but do not/have not fulfilled their obligations in accordance with the provisions of the law. 2. The government's role in layoffs in the context of maintaining the continuity of the business world is associated with investment in Indonesia by guaranteeing the basic rights of workers which is the essence of the drafting of the Job Creation Law, namely realizing the fulfillment of citizens' rights to work and a decent living for human welfare workers who will have an impact on the progress of the business world and investment in Indonesia. 3. Efforts to protect the law against employers for termination of employment in order to maintain the continuity of the business world associated with investment in Indonesia, namely employers are required to fulfill workers' rights in accordance with Law Number 6 of 2023 concerning Stipulation of Government Regulations in lieu of Law Number 2 of 2020 2022 concerning Job Creation, so that there will be no delays in the payment of wages/other rights that must be received by workers/laborers.
