Abstract

Sistem outsourcing merupakan salah satu sistem kerja yang menggunakan jasa alih daya dalam mengelola suatu pekerjaan atau proyek tertentu. Banyak peraturan pemerintah yang membahas tentang sistem outsourcing, tetapi dianggap belum memecahkan masalah karena pekerja masih merasa bahwa sistem outsourcing sangat tidak membela kaum pekerja yang justru menguntungkan bagi perusahaan. Namun karena sulitnya pekerjaan yang tersedia bagi pekerja di Indonesia, sehingga membuat pekerja akhirnya menerima sistem kerja outsourcing yang di buat oleh perusahaan. Outsourcing tengah dan terus menjadi topik pembicaraan hangat di Indonesia hingga saat ini. Outsourcing menjadi sah pasca keluarnya Undang-Undang Nomor 13 Tahun 2003 tentang ketenagakerjaan. Tulisan ini ingin menganalisis perlindungan hukum pekerja outsourcing dalam Undang-Undang tersebut. Masalah tenaga kerja outsourcing bukan lagi merupakan masalah daerah namun sudah menjadi masalah nasional, karena hampir di setiap daerah ada perusahaan yang sudah banyak beralih menggunakan sistem kerja outsourcing. Karena sistem outsourcing tersebut dianggap dapat menghemat lebih besar biaya operasional perusahaan dan lebih menguntungkan perusahaan. Namun dalam implementasinya di lapangan, masih banyak terjadi pelanggaran-pelanggaran yang dilakukan oleh perusahaan-perusahaan penyedia jasa tenaga kerja outsourcing terhadap aturan-aturan yang berkaitan dengan perlindungan hukum terhadap hak-hak konstitusional tenaga kerja outsourcing. Kata Kunci : Outsourcing, perlindungan hukum, pekerja. The outsourcing system is one of the employment systems using outsourced services in certain jobs or projects. Many government regulations stipulated the outsourcing system, however those regulations are not considered as problem solver since workers are still concerned about outsourcing systems that do not support them, but in contrary beneficial to the company. However, due to the difficulty of the availability of works for workers in Indonesia, workers have no choice but to finally accept the outsourcing employment system created by the company. Outsourcing is in debate and continues to be a hot topic in Indonesia until now. Outsourcing system became legal after the issuance of the Manpower Law Number 13 of 2003. This paper analyzes the protection of the outsourced workers under the prevailing law and regulations. The problem of outsourcing is not only a regional problem but has become a national problem, since in every region there are increasing number of companies using outsourcing employment systems and by reason that the preferred outsourcing system can outweigh the company's operational costs and more beneficial to the company. However, in the implementation, there are many violations to the rules related to the legal protection of the constitutional rights of the outsourced workers performed by the companies which provide outsourcing services Keywords : Outsourcing, legal protection, workers.
