Abstract

Latar belakang skripsi ini adalah penagihan kredit macet yang dilakukan oleh jasa pihak ketiga (debt collector) pada pelaksanaannya tidak sesuai dengan peraturan pokokpokok etika penagihan yang sudah ditetapkan oleh Bank Indonesia karena seringkali menimbulkan kerugian bagi konsumen kartu kredit, seperti kasus pada Putusan MA Nomor 3192/K/Pdt/2012 yang merugikan nasabah Bank Standard Chartered karena jasa pihak ketiga (debt collector) yang dikuasakan oleh pihak bank tidak bekerja secara profesional dan menggunakan pendekatan intimidasi serta premanisme. Penelitian ini menggunakan tipe penelitian library research, yang mengkaji berbagai dokumen terkait dengan penelitian. Metode yang digunakan penulis adalah metode penelitian hukum normatif dengan menggunakan pendekatan perundangundangan (statute approach) dan pendekatan kasus (case approach). Hasil Penelitian menunjukkan bahwa penggunaan jasa debt collector dalam penyelesaian kredit macet diperbolehkan dan pengaturannya terdapat didalam Surat Edaran Bank Indonesia No. 14/17/DASP/2012, Peraturan Bank Indonesia No. 14/2/PBI/2012, Booklet Perbankan Indonesia Tahun 2014. Dalam putusan Mahkamah Agung Nomor 3192 K/Pdt/2012 Majelis Hakim menolak permohonan kasasi yang diajukan oleh Pemohon Kasasi dan Menghukum Pemohon Kasasi untuk membayar ganti rugi kepada Termohon Kasasi. Kata Kunci : Debt Collector, Kartu Kredit, Hubungan Hukum Bank dengan Debt Collector, Putusan Hakim The background of this thesis is that the collection of bad credit carried out by the services of a third party (debt collector) in its implementation is not in accordance with the principal collection billing rules set by Bank Indonesia because it often causes losses to consumers of credit cards, such as the case in Decision Supreme Court Number 3192/K/Pdt /2012 which harms the customers of Standard Chartered Bank because the services of a third party (debt collector) authorized by the bank do not work professionally and use an approach of intimidation and thuggery. This study uses a type of research library research, which examines various documents related to research. The method used by the author is a normative legal research method using a statute approach and a case approach. Furthermore, there are three legal materials used in this study, namely primary legal materials, secondary legal materials, and non-legal materials. The result showed that demand for debt collector in the resolution of nonperforming loans allowed and regulations are in circulars bank indonesia number 14 / 17 / dasp / 2012, bank indonesia regulations pbi 14 number / 2 / / 2012, the indonesian banking years 2014. In decisions of the supreme court number 3192 K/Pdt/2012 assembly the judge refused entreaty kasasi submitted by the applicant kasasi punishing an applicant kasasi to indemnify defendant kasas.
