Abstract
Perlindungan terhadap transaksi jual beli aset dalam dunia digital Metaverse terhadap perubahan di era digital sangat perlu diawasi agar hak-hak yang terkandung dalam aktivitas digital, seperti hak eksklusif pencipta, hak moral dan hak ekonomi setiap konsumen digital dapat terjamin dalam menyelami dunia digital tersebut. Hal ini pun tentunya mendorong sisi hukum untuk mempersiapkan regulasi yang relevan dan efektif didalam dunia baru, Metaverse, yang lambat laun pasti akan menelan seluruh lapisan sosial yang karenanya semakin mendesak Peneliti untuk mengidentifikasi masalah yang timbul seperti 1. Bagaimana perlindungan transaksi aset digital dalam dunia Metaverse berdasarkan hukum nasional? 2. Bagaimana penerapan regulasi terhadap transaksi aset digital dalam mendukung pembangunan ekonomi digital di Indonesia? Berdasarkan identifikasi masalah tersebut, maka tujuan dari penelitian ini adalah diantaranya menganlisa perlindungan transaksi aset digital dalam dunia Metaverse berdasarkan hukum nasional dan menganalisa penerapan regulasi terhadap transaksi aset digital dalam mendukung pembangunan ekonomi digital di Indonesia. Penelitian ini menggunakan kerangka teori Teori Hukum Negara Kesejahteraan (Welfare State) menurut Margaret Leiboff serta Teori Hukum Pembangunan menurut Mochtar Kusumaatmadja yang keseluruhannya diteliti dengan metode penelitian kualitatif deskriptif yang menggunakan pendekatan undang-undang dan pendekatan konseptual, serta menggunakan metode pengumpulan data dengan penelitian kepustakaan dan penelitian lapangan yang akhirnya diolah dengan metode kualitatif agar dapat memberikan gambaran yang efektif dan mudah dipahami pembaca. Berdasarkan hasil penelitian, Peneliti mendapatkan konsep teknologi keamanan dalam konteks hukum positif di Indonesia yang meliputi perlindungan hak eksklusif, hak moral, dan hak ekonomi pencipta. Meskipun demikian, peraturan perundang-undangan di Indonesia belum sepenuhnya mengatur dengan jelas dan spesifik mengenai kepemilikan serta perlindungan hukum di ranah digital, terutama dalam konteks perlindungan aset digital di dunia Metaverse. / Safeguarding asset transactions within the digital world like Metaverse in this digital era is deem important in ensuring the rights inherent in digital activities, such as creators' exclusive rights, moral rights, and economic rights of digital consumers, are guaranteed while navigating this digital realm. This necessity also drives the legal aspect to prepare relevant and effective regulations within this whole new world, the Metaverse, which is gradually engulfing all social strata. Consequently, researcher is compelled to identify emerging issues such as: 1. How does the protection of digital asset transactions within the Metaverse align with national laws? 2. How does the implementation of regulations pertaining to digital asset transactions support digital economic development in Indonesia? Based on this problem identification, the objectives of this research includes analyzing the protection of digital asset transactions within the Metaverse in accordance with national law and assessing the application of regulations concerning digital asset transactions in support of digital economic development in Indonesia. This research employs the theoretical framework of the Welfare State according to Margaret Leiboff, and the Development Law theory by Mochtar Kusumaatmadja, all of which are comprehensively examined through a qualitative descriptive research method employing both legal and conceptual approaches. Data collection methods include extensive literature review and field research, subsequently analyzed using qualitative methodology to provide an effective and comprehensible overview to readers. Based on the research findings, the researcher has formulated the concept of security technology within the context of positive law in Indonesia, encompassing the protection of exclusive rights, moral rights, and economic rights of creators. However, it is important to note that the current legal framework in Indonesia does not comprehensively and specifically regulate ownership and legal protection in the digital realm, particularly concerning the protection of digital assets in the world of the Metaverse. This underscores the need for further legal development and regulatory clarity in this rapidly evolving digital landscape.
