Abstract

Setiap CPMI/PMI mempunyai hak memperoleh perlindungan sesuai dengan peraturan perundang-undangan yang belaku. Pihak pemerintah, swasta, dan mitra usaha luar negeri wajib memberikan perlindungan terhadap PMI di Negara manapun mereka berada, koordinasi dari para pihak tersebut sangat dibutuhkan demi tercapai perlindungan terhadap keselamatan PMI. Maraknya kasus PMI di Arab Saudi yang menunjukan bahwa perlindungan terhadap PMI belum dilakukan dengan maksimal. Pemerintah pun berupaya kuat dalam melindungi PMI tetapi tidak dipungkiri masih adanya faktor dalam menghambat upaya pemerintah. Berdasarkan permasalahan yang di teliti maka metode penelitian hukum yang dipakai bersifat normatif. Dengan pendekatan perundang-undangan, dimana penulis menggambarkan perlindungan hukum PMI sesuai dengan regulasi yang berlaku. Dari hasil penelitian terhadap bentuk perlindungan terhadap PMI yang ada di dalam UU No. 18 Tahun 2017 yakni dimulai dari sebelum, selama, dan sesudah bekerja. Faktor-faktor yang dapat menghambat pemerintah dalam melindungi PMI yakni perbedaan wilayah hukum, yaitu wilayah hukum nasional dan wilayah hukum Negara penerima/tempat dimana tenaga kerja tersebut bekerja. Untuk menjamin perlindungan dari PMI alangkah lebih baik bila pemerintah meningkatkan pembinaan dan penyuluhan bagi para CPMI yang akan bekerja, sehingga para PMI siap untuk diterjunkan. Kata Kunci : Perlindungan Hukum, Pekerja Migran Indonesia, Arab Saudi Each the candidates of migrants workers have the right to be protected in accordance with the legislation in force. Government, private (recruitment agency), and overseas business partners are required to provide protection to migrant workers any country they are in, the coordination of the parties is necessary in order to achieve the protection of the safety of workers. The rise of cases in Saudi Arabia involving migrant workers recently showed that the protection of migrant workers has not been carried out to the maximum by the parties. The government also tried their best in protecting the PMI but it was undeniable that there were still factors in hampering the government's efforts. Based on the problems examined, the legal research method that beingused is normative.With a legal approach, where the author describes the legal protection of PMI in accordance with applicable regulations. From the results of form of migrants workers protection in Act No. 18, 2017, starting from before, during, and after work. Factors that can block the government in protecting migrant workers are differences in jurisdiction, that is the national jurisdiction and the jurisdiction of the receiving country or the place where the migrant workers works.Toguarantee the protection of migrant workers, furthermore it would be better if the government increased coaching and counseling for the candidates of migrants workersthat would work, so that they were ready to work overseas.
