Abstract

Dalam konteks perlindungan hak asasi manusia, perlindungan anak bukan semata-mata merupakan masalah nasional suatu bangsa, tetapi juga merupakan masalah internasional. Anak berhak atas pemeliharaan dan perlindungan,anak membutuhkan kasih sayang yang utuh, serta harus mendapatkan perlindungan dari orang tuanya, anak sangat membutuhkan lingkungan keluarga untuk perkembangan kepribadiannya dengan cara memberikan kasih sayang dari orang tua kandungnya serta keluarga dekat terhadap dirinya. Rumusan masalah dalam skripsi ini adalah bagaimanakah pengaturan hukum pidana terhadap orang tua dalam kasus narkoba yang di hukum mati dan bagaimanakah perlindungan hukum terhadap hak anak atas dijatuhinya pidana mati terhadap orangtuanya berdasarkan Undang-Undang Perlindungan Anak. Penelitian ini menggunakan penelitian hukum normatif dengan menggunakan pendekatan Undang-Undang dan perbandingan hukum. Hasil dari penelitian ini menunjukkan anak korban dari terpidana mati orang tuanya, memerlukan peran pemerintah dalam pemenuhan hakhak anak serta penjatuhan hukuman mati di indonesia perlu ditinjau kembali karena bertentangan dengan HAM. / In contexts of protection of human rights, children protection not only a national problem of a nation but it is also an international problem. Children have the rights for maintenance and protection, children need complete affection, also have to get protection from his parents, children really needs family environment to his personality development by giving affection from his biological parents also from their closest family. The formulation of the problem in this writing is how the regulation of criminal law against defendants in drug cases who are sentenced to death and how is the legal protection of the rights of children against their parents sentenced to death based on the child protection law. This method used in this writing is normative juridical approach with analysing secondary data or references materials. Law, court ruling, book, journal, website, and another materials of references that used in this writing including legal dictionary related to large case studies. Result of this research is showed that the children who his parents were sentenced to death, needs the role of the government in fulfilling children’s rights and also the imposition of death sentenced in Indonesia need to be reviewed because it violates human rights.
