Abstract

Kekerasan terjadi bukan saja dalam area publik, namun marak terjadi juga dalam area domestik yang melahirkan kekerasan dalam rumah tangga. Ironisnya, perempuan khususnya istri adalah korban kekerasan dalam rumah tangga. Penelitian ini dilaksanakan bertujuan untuk memahami dan mengetahui Penerapan Undang-Undang Nomor 23 Tahun 2004 Tentang Penghapusan Kekerasan Dalam Rumah Tangga dalam kasus KDRT serta mengkaji akibat hukum yang akan ditimbulkan dari KDRT dari Hukum Pidana. Penelitian ini menggunakan bahan hukum primer berupa Kitab Undang-Undang Hukum Perdata, Undang-Undang Nomor 23 Tahun 2004 Tentang Penghapusan Kekerasan Dalam Rumah Tangga, Putusan Pengadilan Negeri Meureudu Nomor 65/Pid.Sus/2020/PN.Mrn serta bahan hukum sekunder berupa bahan yang berkaitan dengan penerapan UU tentang KDRT, dan bahan hukum tersier Kamus Bahasa Indonesia. Menggunakan bahan yang disebutkan, penelitian ini merupakan penelitian hukum normatif menggunakan metode kepustakaan. Hasil pada penelitian ini menyebutkan bahwa melalui Undang-Undang Nomor 23 Tahun 2004 Tentang Penghapusan Kekerasan Dalam Rumah Tangga telah mengatur apa saja yang termasuk dalam Kekerasan Dalam Rumah Tangga (KDRT). Hal ini termasuk kekerasan fisik, psikis dan seksual. Lalu, temuan selanjutnya adalah berdasarkan Putusan Pengadilan Negeri NOMOR : 65/Pid.Sus/2020/PN.Mrn telah terjadi tindak pidana Kekerasan Dalam Rumah Tangga. Ironically, women—especially wives—are the most often victims of domestic violence. This study conducted to comprehend the implementation of Law Number 23 of 2004 on the Elimination of Domestic Violence in the case of the Corruption Eradication Commission, as well as to investigate the legal ramifications of the Corruption Eradication Commission's criminal law. The Civil Law Law, Law Number 23 of 2004 on the Elimination of Domestic Violence, and Meureudu District Court Decision Number 65/Pid. Sus/2020/PN were the key legal sources used in this study. The KDR Indonesian language dictionary contains information relating to the implementation of the law, including Mr. and secondary legal documents. This research is a normative legal study employing library techniques using the mentioned resources. The results of this study suggest that Law Number 23 of 2004 on the Elimination of Domestic Violence has regulated what is included in domestic violence (KDRT). This includes physical, psychic, and sexual violence. Then, the next finding is based on the District Court Decision Number: 65/Pid. Sus/2020/PN.mr that KDRT occurred.
