Abstract

Latar belakang masalah penelitian ini adalah untuk menganalisis perlindungan hukum terhadap korban pornografi balas dendam (revenge porn.) Revenge porn termasuk kejahatan siber yang ditujukan untuk balas dendam. Pelaku biasanya mantan kekasih yang melakukan balas dendam dengan menyebarkan konten muatan asusila milik korban tanpa persetujuan. Dampak yang diberikan terhadap korban sangat buruk terhadap kesehatan mental dan psikologis. Metode penelitian yang digunakan metode hukum normatif dengan pendekatan Undang-Undang dan Kasus. Teknik pengumpulan data menggunakan tinjauan pustaka. Dengan menganalisis KUHP, UU No 44/2008 tentang Pornografi, UU No 19/2016 mengubah UU No 11/2008, UU No 1/2023 tentang KUHP, UU No 12/2022 serta Putusan No 217/PID.SUS/2021/PN DMK yang dapat digunakan sebagai dasar analisis tindak kejahatan pornografi balas dendam.Hasil dari penelitian ini memberikan analisis bahwa dalam Putusan Nomor 217/Pid.Sus/2021/PN Dmk perlindungan hukum terhadap korban secara hukum sudah melindungi tetapi belum adanya perlindungan secara restitusi dan rehabilitasi terhadap korban pornografi balas dendam. Perlindungan terhadap korban diberikan oleh negara melalui, Komnas Perempuan dan Lembaga Perlindungan Saksi dan Korban (LPSK). / The background of this research problem is to analyze legal protection for victims of revenge porn. Revenge porn is a cyber crime aimed at revenge. The perpetrators are usually ex-lovers who take revenge by spreading the contents of the victim's immoral content without consent. The impact given to victims is very bad for mental and psychological health. The research method used is the normative legal method with the Statute approach and Case approach. The data collection technique uses a literature review. By analyzing the Criminal Code, Law No. 44/2008 concerning Pornography, Law No. 19/2016 amended Law No. 11/2008, Law No. 1/2023 concerning the Criminal Code, Law No. 12/2022 and Decision No. 217/PID.SUS/2021/PN DMK which can be used as a basis for analysis of revenge pornography crimes. The results of this study provide an analysis that in Decision Number 217/Pid.Sus/2021/PN Dmk legal protection for victims legally protects but there is no protection in terms of restitution and rehabilitation for victims of revenge pornography. Protection for victims is provided by the state through National Commission on Violence against Women and the Witness and Victim Protection Agency (LPSK).
