Abstract

Umumnya banyak masyarakat di daerah-daerah Indonesia mengeluhkan tentang pembangunan jalan yang kapasitasnya tidak sesuai dengan yang direncanakan, misalnya kapasitas jalan yang seharusnya bertahan 5 (lima) tahun namun pada kenyataannya hanya bertahan 1 (satu) tahun setelah pembangunan dilaksanakan. Hal ini menyebabkan timbulnya pemikiran�pemikiran kritis dari masyarakat yang menganggap bahwa pemerintah hanya menjadikan pembangunan infrastruktur jalan sebagai alasan agar supaya setiap dana yang diberikan untuk pembangunan dapat di sisipkan untuk kepentingan personal. Maka dari itu Penulis tertarik melihat bagaimana implementasi DPRD di Kabupaten Sitaro. Skripsi ini mempunyai 2 (dua) perumusan masalah, yakni: (1) Apakah implementasi fungsi pengawasan di DPRD berjalan efektif dan efisien? dan (2) Bagaimana akibat hukum apabila dalam pelaksanaan APBD yang tidak sesuai dengan ketentuan perundang-undangan?. Jenis penelitian yang digunakan dalam penelitian ini peneliti menggunakan penelitian yuridis normatif tetapi dalam dalam pelaksanaannya didukung dengan penelitian yuridis empiris untuk mendapatkan data primer melalui wawancara dengan anggota DPRD. Sumber Data yang digunakan ialah: Data Primer dan Data Sekunder (studi kepustakaan). Hasil penelitian menjelaskan bahwa Implementasi fungsi pengawasan di DPRD Kabupaten Sitaro berjalan sesuai dengan asas-asas umum pemerintahan yang baik, hal ini dikarenakan terbukanya transparansi di depan masyarakat, berarti pemerintah daerah mengelola keuangan secara terbuka, sebab keuangan itu adalah milik rakyat atau barang publik yang harus diketahui oleh masyarakat. Pemerintah daerah wajib menyampaikan informasi secara terbuka APBD kepada masyarakat. Akibat Hukum Apabila Dalam Pelaksanaan APBD yang tidak sesuai dengan ketentuan perundang-undangan, maka akan dikenakan sanksi sesuai Ketentuan Peraturan Menteri Keuangan Tentang Tata Cara Penyampaian Informasi Keuanga Daerah, yaitu terdapat pada Pasal 8 ayat (1) dan (2). Kata kunci : Anggaran, Pemerintah Daerah. / In general, many people in Indonesian regions complain about road construction whose capacity is not as planned, for example the capacity of a road that should have lasted 5 (five) years but in fact only lasted 1 (one) year after the construction was carried out. This has led to the emergence of critical thoughts from the public who think that the government is only using road infrastructure development as an excuse so that any funds given for development can be inserted for personal gain. Therefore the author is interested in seeing how the DPRD is implemented in Sitaro Regency. This thesis has 2 (two) problems, namely: (1) Does the implementation of the oversight function in DPRD run effectively and efficiently? and (2) What are the legal consequences if the implementation of the APBD is not in accordance with statutory provisions?The type of research used in this research is normative juridical research but in its implementation it is supported by empirical juridical research to obtain primary data through interviews with DPRD members. Data sources used are: Primary Data and Secondary Data (literature study). The results of the study explain that the implementation of the oversight function in the Sitaro Regency DPRD is in accordance with the principles of good public governance, this is due to the openness of transparency in front of the community, meaning that the regional government manages finances openly, because finance belongs to the people or public goods that must be known by the public. Local governments are required to openly disclose APBD information to the public. Legal Consequences If the implementation of the APBD is not in accordance with the provisions of laws and regulations, sanctions will be imposed in accordance with the provisions of the Minister of Finance Regulation concerning Procedures for Submitting Regional Financial Information, which are contained in Article 8 paragraph (1) and (2).
