Abstract
Investasi yang sedang diminati dan bertumbuh di Indonesia adalah Investasi trading, hal ini di dorong keterlibatan sebagai orang yang mempromosikan investasi tersebut, karena fenomena influencer dan pengaruhnya terhadap masyarakat Indonesia sangat besar. Tujuan penelitian ini adalah mengetahui secara yuridis tentang tanggung jawab hukum influencer dalam memasarkan platform investasi melalui sosial media yang berlaku di Indonesia. Metode penelitian yang digunakan yaitu hukum normatif metode penelitian penelitian deskriptif. Lalu berkaitan dengan sumber data, sumber data terdiri dari data sekunder dan undang – undang, kasus hukum, karya ilmiah dan teknik analisis kualitatif. Penelitian ini menyimpulkan, pengaturan dalam memasarkan platform investasi di media sosial diatur di dalam UU PK dan UU ITE. Sedangkan hubungan kerja antara dengan platform investtasi dalam memasarkan platform investasi di media sosial adalah berdasarkan perjanjian, namun karena dilaksanakan didalam jaringan elektronik, maka termasuk kedalam perjanjian elektronik, dimana pertanggungjawabanya dilakukan melalui upaya jalur non-litigasi sesuai ketentuan penyelesaian sengketa pasal 39 UU ITE. Untuk pengaturan hukum kegiatan pemasaran platform investasi yang illegal, adalah termasuk unsur-unsur tindak pidana penipuan dalam pasal 378 KUHP dan Pasal 28 ayat 1 UU ITE. Berkaitan dengan tanggung jawab kepada korban, dapat diajukan pidana penggabungan berdasarkan pasal 98 – 101 KUHAPidana./ Investments that are currently in demand and growing in Indonesia isinvestment trading, this is encouraged by the involvement of s as people who promote these investments because their influence on Indonesian society is very influential The purpose of this study is to understand legally the legal responsibilities of s in promoting investment s through social media that apply in Indonesia. The research method used is normative legal research method descriptive research. Then with regard to data sources, data sources consist of secondary data and laws, legal cases, scientific works and qualitative analysis techniques. This research concludes, arrangements in marketing investment s on social media are regulated in the Consumer Protection Law and the Information, electronic information and transaction Law. While the relationship between s and investment s in marketing investment s on social media is based on an agreement, but because it is carried out in an electronic network, it is included in an electronic agreement, where accountability is carried out through non-litigation efforts in accordance with the dispute resolution provisions of article 39 of the electronic information and transcation Law. For legal arrangements for illegal investment marketing activities, elements of the criminal act of fraud are included in Article 378 of the Criminal Code and Article 28 paragraph 1 of the electronic information and transcation Law. With regard to responsibility to the victim, a combined sentence can be proposed under Articles 98 – 101 of the Criminal Code
